66 AN ACT
77 relating to early voting by mail by any qualified voter and to the
88 repeal of certain criminal offenses concerning the solicitation and
99 distribution of an application to vote by mail.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 13.002(e), Election Code, is amended to
1212 read as follows:
1313 (e) Notwithstanding Section 82.005, a [A] person who is
1414 certified for participation in the address confidentiality program
1515 administered by the attorney general under Subchapter B, Chapter
1616 58, Code of Criminal Procedure, is not eligible for early voting by
1717 mail [under Section 82.007] unless the person submits an
1818 application under this section by personal delivery. The secretary
1919 of state may adopt rules to implement this subsection.
2020 SECTION 2. Section 82.005, Election Code, is amended to
2121 read as follows:
2222 Sec. 82.005. ELIGIBILITY FOR EARLY VOTING [BY PERSONAL
2323 APPEARANCE]. Any qualified voter is eligible for early voting by
2424 mail or personal appearance.
2525 SECTION 3. Section 82.007, Election Code, is amended to
2626 read as follows:
2727 Sec. 82.007. PARTICIPATION IN ADDRESS CONFIDENTIALITY
2828 PROGRAM. Notwithstanding Section 82.005, a [A] qualified voter
2929 who, [is eligible for early voting by mail if:
3030 [(1) the voter submitted a registration application by
3131 personal delivery as required by Section 13.002(e); and
3232 [(2)] at the time the voter's early voting ballot
3333 application is submitted, [the voter] is certified for
3434 participation in the address confidentiality program administered
3535 by the attorney general under Subchapter B, Chapter 58, Code of
3636 Criminal Procedure, is eligible for early voting by mail only if the
3737 voter submitted a registration application by personal delivery as
3838 required by Section 13.002(e).
3939 SECTION 4. Section 84.001(a), Election Code, is amended to
4040 read as follows:
4141 (a) To be entitled to vote an early voting ballot by mail, a
4242 person [who is eligible for early voting] must make an application
4343 for an early voting ballot to be voted by mail as provided by this
4444 title.
4545 SECTION 5. Section 84.002(a), Election Code, is amended to
4646 read as follows:
4747 (a) An early voting ballot application must include:
4848 (1) the applicant's name and the address at which the
4949 applicant is registered to vote;
5050 (1-a) the following information:
5151 (A) the number of the applicant's driver's
5252 license, election identification certificate, or personal
5353 identification card issued by the Department of Public Safety;
5454 (B) if the applicant has not been issued a number
5555 described by Paragraph (A), the last four digits of the applicant's
5656 social security number; or
5757 (C) a statement by the applicant that the
5858 applicant has not been issued a number described by Paragraph (A) or
5959 (B);
6060 (2) for an application for a ballot to be voted by mail
6161 by an applicant who will be absent from the applicant's [on the
6262 ground of absence from the] county of residence on election day, the
6363 address outside the applicant's county of residence to which the
6464 ballot is to be mailed;
6565 (3) for an application for a ballot to be voted by mail
6666 by an applicant who is 65 years of age or older on election day or
6767 has a sickness or physical condition that requires the applicant to
6868 reside in a hospital or nursing home or other long-term care
6969 facility, or with a relative [on the ground of age or disability],
7070 the address of the hospital, nursing home or other long-term care
7171 facility, or retirement center, or of a person related to the
7272 applicant within the second degree by affinity or the third degree
7373 by consanguinity, as determined under Chapter 573, Government Code,
7474 if the applicant is living at that address and that address is
7575 different from the address at which the applicant is registered to
7676 vote;
7777 (4) for an application for a ballot to be voted by mail
7878 by an applicant who is confined [on the ground of confinement] in
7979 jail as described by Section 84.009(a), the address of the jail or
8080 of a person related to the applicant within the degree described by
8181 Subdivision (3);
8282 (5) [for an application for a ballot to be voted by
8383 mail on any ground,] an indication of each election for which the
8484 applicant is applying for a ballot; and
8585 (6) [an indication of the ground of eligibility for
8686 early voting; and
8787 [(7)] for an application for a ballot to be voted by
8888 mail by an applicant who is civilly committed as a sexually violent
8989 predator under Chapter 841, Health and Safety Code, and is ordered
9090 as a condition of civil commitment to reside in a facility operated
9191 by or under contract with the Texas Civil Commitment Office [on the
9292 ground of involuntary civil commitment], the address of the
9393 facility operated by or under contract with the Texas Civil
9494 Commitment Office or of a person related to the applicant within the
9595 degree of consanguinity described by Subdivision (3).
9696 SECTION 6. Section 84.009, Election Code, is amended by
9797 amending Subsection (a) and adding Subsection (b) to read as
9898 follows:
9999 (a) This section applies only to an applicant who, at the
100100 time the application for a ballot to be voted by mail is submitted,
101101 is confined in jail:
102102 (1) serving a misdemeanor sentence for a term that
103103 ends on or after election day;
104104 (2) pending trial after denial of bail;
105105 (3) without bail pending an appeal of a felony
106106 conviction; or
107107 (4) pending trial or appeal on a bailable offense for
108108 which release on bail before election day is unlikely.
109109 (b) On request of the applicant, an application for a ballot
110110 to be voted by mail [on the ground of confinement in jail] may be
111111 submitted to the early voting clerk, at the discretion of the
112112 authority in charge of the jail, by personal delivery by the jail
113113 authority or by a designated subordinate of the authority.
114114 SECTION 7. Section 84.011(a), Election Code, is amended to
115115 read as follows:
116116 (a) The officially prescribed application form for an early
117117 voting ballot must include:
118118 (1) immediately preceding the signature space the
119119 statement: "I certify that the information given in this
120120 application is true, and I understand that giving false information
121121 in this application is a crime.";
122122 (2) a statement informing the applicant of the
123123 offenses prescribed by Sections 84.003 and 84.004;
124124 (3) spaces for entering an applicant's voter
125125 registration number and county election precinct of registration,
126126 with a statement informing the applicant that failure to furnish
127127 that information does not invalidate the application;
128128 (3-a) a space for entering the information required
129129 under Section 84.002(a)(1-a); and
130130 (4) on an application for a ballot to be voted by mail:
131131 (A) a space for an applicant [applying on the
132132 ground of absence from the county of residence] to indicate whether
133133 the applicant will be absent from the applicant's county of
134134 residence on election day and, if applicable, the date on or after
135135 which the applicant can receive mail at the address outside the
136136 county;
137137 (B) a space for indicating the fact that an
138138 applicant whose application is signed by a witness cannot make the
139139 applicant's mark and a space for indicating the relationship or
140140 lack of relationship of the witness to the applicant;
141141 (C) a space for entering an applicant's telephone
142142 number, with a statement informing the applicant that failure to
143143 furnish that information does not invalidate the application;
144144 (D) a space or box for an applicant who is 65
145145 years of age or older on election day or has a sickness or physical
146146 condition that requires the applicant to reside in a hospital or
147147 nursing home or other long-term care facility, or with a relative,
148148 [applying on the ground of age or disability] to indicate that the
149149 address to which the ballot is to be mailed is the address of a
150150 facility or relative described by Section 84.002(a)(3), if
151151 applicable;
152152 (E) a space or box for an applicant who is
153153 confined [applying on the ground of confinement] in jail as
154154 described by Section 84.009(a) or who is civilly committed as a
155155 sexually violent predator under Chapter 841, Health and Safety
156156 Code, and ordered as a condition of civil commitment to reside in a
157157 facility operated by or under contract with the Texas Civil
158158 Commitment Office, [involuntary civil commitment] to indicate that
159159 the address to which the ballot is to be mailed is the address of a
160160 relative described by Section 84.002(a)(4) or (6) [(7)], if
161161 applicable;
162162 (F) a space for an applicant [applying on the
163163 ground of age or disability] to indicate if the application is an
164164 application under Section 86.0015;
165165 (G) spaces for entering the signature, printed
166166 name, and residence address of any person assisting the applicant;
167167 (H) a statement informing the applicant of the
168168 condition prescribed by Section 81.005; and
169169 (I) a statement informing the applicant of the
170170 requirement prescribed by Section 86.003(c).
171171 SECTION 8. Sections 86.001(b) and (c), Election Code, are
172172 amended to read as follows:
173173 (b) If the application complies with the applicable
174174 requirements prescribed by this title [applicant is entitled to
175175 vote an early voting ballot by mail], the clerk shall provide an
176176 official ballot to the applicant as provided by this chapter.
177177 (c) Except as provided by Section 86.008, if the applicant
178178 is not entitled to vote in the election [by mail], the clerk shall
179179 reject the application, enter on the application "rejected" and the
180180 reason for and date of rejection, and deliver written notice of the
181181 reason for the rejection to the applicant at both the residence
182182 address and mailing address on the application. A ballot may not be
183183 provided to an applicant whose application is rejected.
184184 SECTION 9. Section 86.0015(a), Election Code, is amended to
185185 read as follows:
186186 (a) This section applies only to an application for a ballot
187187 to be voted by mail that[:
188188 [(1) indicates the ground of eligibility is age or
189189 disability; and
190190 [(2)] does not specify the election for which a ballot
191191 is requested or has been marked by the applicant as an application
192192 for more than one election.
193193 SECTION 10. Section 86.003(c), Election Code, is amended to
194194 read as follows:
195195 (c) The address to which the balloting materials must be
196196 addressed is the address at which the voter is registered to vote,
197197 or the registered mailing address if different, unless the
198198 application to vote early by mail indicates that the voter [ground
199199 for voting by mail is]:
200200 (1) will be absent from the voter's [absence from the]
201201 county of residence on election day, in which case the address must
202202 be an address outside the voter's county of residence;
203203 (2) is confined [confinement] in jail as described by
204204 Section 84.009(a), in which case the address must be the address of
205205 the jail or of a relative described by Section 84.002(a)(4);
206206 (3) is 65 years of age or older on election day or has a
207207 sickness or physical condition that requires the applicant to
208208 reside in a hospital or nursing home or other long-term care
209209 facility, or with a relative, [age or disability] and [the voter] is
210210 living at a hospital, nursing home or other long-term care
211211 facility, or retirement center, or with a relative described by
212212 Section 84.002(a)(3), in which case the address must be the address
213213 of that facility or relative; or
214214 (4) is civilly committed as a sexually violent
215215 predator under Chapter 841, Health and Safety Code, and ordered as a
216216 condition of civil commitment to reside in a facility operated by or
217217 under contract with the Texas Civil Commitment Office [involuntary
218218 civil commitment], in which case the address must be the address of
219219 the facility or of a relative described by Section 84.002(a)(6)
220220 [84.002(a)(7)].
221221 SECTION 11. Section 86.004(b), Election Code, is amended to
222222 read as follows:
223223 (b) For an election to which Section 101.104 applies, the
224224 balloting materials for a voter who indicates on the application
225225 for a ballot to be voted by mail or the federal postcard application
226226 that the voter seeks [is eligible] to vote early by mail as a
227227 consequence of the voter's being outside the United States shall be
228228 mailed on or before the later of the 45th day before election day or
229229 the seventh calendar day after the date the clerk receives the
230230 application. However, if it is not possible to mail the ballots by
231231 the deadline of the 45th day before election day, the clerk shall
232232 notify the secretary of state within 24 hours of knowing that the
233233 deadline will not be met. The secretary of state shall monitor the
234234 situation and advise the clerk, who shall mail the ballots as soon
235235 as possible in accordance with the secretary of state's guidelines.
236236 SECTION 12. Section 87.041(b), Election Code, is amended to
237237 read as follows:
238238 (b) A ballot may be accepted only if:
239239 (1) the carrier envelope certificate is properly
240240 executed;
241241 (2) neither the voter's signature on the ballot
242242 application nor the signature on the carrier envelope certificate
243243 is determined to have been executed by a person other than the
244244 voter, unless signed by a witness;
245245 (3) [the voter's ballot application states a legal
246246 ground for early voting by mail;
247247 [(4)] the voter is registered to vote, if registration
248248 is required by law;
249249 (4) [(5) the address to which the ballot was mailed
250250 to the voter, as indicated by the application, was outside the
251251 voter's county of residence, if the ground for early voting is
252252 absence from the county of residence;
253253 [(6)] for a voter to whom a statement of residence form
254254 was required to be sent under Section 86.002(a), the statement of
255255 residence is returned in the carrier envelope and indicates that
256256 the voter satisfies the residence requirements prescribed by
257257 Section 63.0011;
258258 (5) [(7)] the address to which the ballot was mailed
259259 to the voter is an address [that is otherwise] required by Sections
260260 84.002 and 86.003; and
261261 (6) [(8)] the information required under Section
262262 86.002(g) provided by the voter identifies the same voter
263263 identified on the voter's application for voter registration under
264264 Section 13.002(c)(8).
265265 SECTION 13. Section 102.001(a), Election Code, is amended
266266 to read as follows:
267267 (a) A qualified voter is eligible to vote a late ballot as
268268 provided by this chapter if the voter has a sickness or physical
269269 condition [described by Section 82.002] that prevents the voter
270270 from appearing at the polling place on election day without a
271271 likelihood of needing personal assistance or of injuring the
272272 voter's health and originates on or after the day before the last
273273 day for submitting an application for a ballot to be voted by mail.
274274 SECTION 14. The following provisions of the Election Code
275275 are repealed:
276276 (1) Section 82.001;
277277 (2) Section 82.002;
278278 (3) Section 82.003;
279279 (4) Section 82.004;
280280 (5) Section 82.008;
281281 (6) Sections 84.002(b) and (c);
282282 (7) Section 84.0111;
283283 (8) Section 112.002(b);
284284 (9) Section 276.016; and
285285 (10) Section 276.017.
286286 SECTION 15. The changes in law made by this Act apply only
287287 to an election ordered on or after September 1, 2023.
288288 SECTION 16. This Act takes effect September 1, 2023.
