7 | 7 | | relating to the issuance of a license to carry a handgun to certain |
---|
8 | 8 | | active and retired judicial officers. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 411.201(a)(1) and (3), Government Code, |
---|
11 | 11 | | are amended to read as follows: |
---|
12 | 12 | | (1) "Active judicial officer" means: |
---|
13 | 13 | | (A) a person serving as a judge or justice of the |
---|
14 | 14 | | supreme court, the court of criminal appeals, a court of appeals, a |
---|
15 | 15 | | district court, a criminal district court, a constitutional county |
---|
16 | 16 | | court, a statutory county court, a statutory probate court, a |
---|
17 | 17 | | justice court, or a municipal court; |
---|
18 | 18 | | (B) a federal judge who is a resident of this |
---|
19 | 19 | | state; or |
---|
20 | 20 | | (C) a person appointed and serving as an |
---|
21 | 21 | | associate judge under Chapter 201, Family Code. |
---|
22 | 22 | | (3) "Retired judicial officer" means: |
---|
23 | 23 | | (A) a visiting judge appointed to serve as the |
---|
24 | 24 | | judge of a constitutional county court, a statutory county court, |
---|
25 | 25 | | or a statutory probate court [under Section 26.023 or 26.024]; |
---|
26 | 26 | | (B) a senior judge designated under Section |
---|
27 | 27 | | 75.001 or a judicial officer as designated or defined by Section |
---|
28 | 28 | | 75.001, 831.001, or 836.001; or |
---|
29 | 29 | | (C) a retired federal judge who is a resident of |
---|
30 | 30 | | this state. |
---|
31 | 31 | | SECTION 2. The change in law made by this Act applies only |
---|
32 | 32 | | to an offense committed on or after the effective date of this Act. |
---|
33 | 33 | | An offense committed before the effective date of this Act is |
---|
34 | 34 | | governed by the law in effect on the date the offense was committed, |
---|
35 | 35 | | and the former law is continued in effect for that purpose. For |
---|
36 | 36 | | purposes of this section, an offense was committed before the |
---|
37 | 37 | | effective date of this Act if any element of the offense occurred |
---|
38 | 38 | | before that date. |
---|
39 | 39 | | SECTION 3. This Act takes effect September 1, 2023. |
