| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 301, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 301.1575 to read as follows: |
|---|
| 12 | 12 | | Sec. 301.1575. APPROVAL AND OPERATION OF VOCATIONAL NURSING |
|---|
| 13 | 13 | | EDUCATIONAL PROGRAMS. The board may not adopt a rule applicable to |
|---|
| 14 | 14 | | the approval or operation of a vocational nursing educational |
|---|
| 15 | 15 | | program that: |
|---|
| 16 | 16 | | (1) requires the applicant to submit, as part of the |
|---|
| 17 | 17 | | application for approval, letters in support of the program's |
|---|
| 18 | 18 | | proposed operation in the community; |
|---|
| 19 | 19 | | (2) requires initial approval to be on a provisional |
|---|
| 20 | 20 | | basis; |
|---|
| 21 | 21 | | (3) imposes a limit on enrollment; |
|---|
| 22 | 22 | | (4) requires the program to have a licensing |
|---|
| 23 | 23 | | examination passage rate that exceeds: |
|---|
| 24 | 24 | | (A) 80 percent for the first two academic years |
|---|
| 25 | 25 | | for which graduates are eligible to take the licensing examination; |
|---|
| 26 | 26 | | or |
|---|
| 27 | 27 | | (B) 70 percent for any subsequent academic year; |
|---|
| 28 | 28 | | or |
|---|
| 29 | 29 | | (5) prohibits a program with more than one campus from |
|---|
| 30 | 30 | | combining licensing examination passage rates for graduates from |
|---|
| 31 | 31 | | all campuses when determining the program's passage rate for an |
|---|
| 32 | 32 | | academic year. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
