6	6	AN ACT
7	7	relating to an indicator of achievement for military readiness
8	8	under the public school accountability system.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 39.053(c), Education Code, is amended to
11	11	read as follows:
12	12	(c) School districts and campuses must be evaluated based on
13	13	three domains of indicators of achievement adopted under this
14	14	section that include:
15	15	(1) in the student achievement domain, indicators of
16	16	student achievement that must include:
17	17	(A) for evaluating the performance of districts
18	18	and campuses generally:
19	19	(i) an indicator that accounts for the
20	20	results of assessment instruments required under Sections
21	21	39.023(a), (c), and (l), as applicable for the district and campus,
22	22	including the results of assessment instruments required for
23	23	graduation retaken by a student, aggregated across grade levels by
24	24	subject area, including:
25	25	(a) for the performance standard
26	26	determined by the commissioner under Section 39.0241(a), the
27	27	percentage of students who performed satisfactorily on the
28	28	assessment instruments, aggregated across grade levels by subject
29	29	area; and
30	30	(b) for the college readiness
31	31	performance standard as determined under Section 39.0241, the
32	32	percentage of students who performed satisfactorily on the
33	33	assessment instruments, aggregated across grade levels by subject
34	34	area; and
35	35	(ii) an indicator that accounts for the
36	36	results of assessment instruments required under Section
37	37	39.023(b), as applicable for the district and campus, including the
38	38	percentage of students who performed satisfactorily on the
39	39	assessment instruments, as determined by the performance standard
40	40	adopted by the agency, aggregated across grade levels by subject
41	41	area; and
42	42	(B) for evaluating the performance of high school
43	43	campuses and districts that include high school campuses,
44	44	indicators that account for:
45	45	(i) students who satisfy the Texas Success
46	46	Initiative (TSI) college readiness benchmarks prescribed by the
47	47	Texas Higher Education Coordinating Board under Section 51.334 on
48	48	an assessment instrument in reading or mathematics designated by
49	49	the coordinating board under that section;
50	50	(ii) students who satisfy relevant
51	51	performance standards on advanced placement tests or similar
52	52	assessments;
53	53	(iii) students who earn dual course credits
54	54	in the dual credit courses;
55	55	(iv) students who demonstrate military
56	56	readiness by:
57	57	(a) enlisting [enlist] in the armed
58	58	forces of the United States or the Texas National Guard;
59	59	(b) achieving a passing score set by
60	60	the applicable military branch on the Armed Services Vocational
61	61	Aptitude Battery test; or
62	62	(c) successfully completing a Junior
63	63	Reserve Officer Training Corps program;
64	64	(v) students who earn industry
65	65	certifications;
66	66	(vi) students admitted into postsecondary
67	67	industry certification programs that require as a prerequisite for
68	68	entrance successful performance at the secondary level;
69	69	(vii) students whose successful completion
70	70	of a course or courses under Section 28.014 indicates the student's
71	71	preparation to enroll and succeed, without remediation, in an
72	72	entry-level general education course for a baccalaureate degree or
73	73	associate degree;
74	74	(viii) students who successfully met
75	75	standards on a composite of indicators that through research
76	76	indicates the student's preparation to enroll and succeed, without
77	77	remediation, in an entry-level general education course for a
78	78	baccalaureate degree or associate degree;
79	79	(ix) high school graduation rates, computed
80	80	in accordance with standards and definitions adopted in compliance
81	81	with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
82	82	subject to the exclusions provided by Subsections (g), (g-1),
83	83	(g-2), (g-3), and (g-4);
84	84	(x) students who successfully completed an
85	85	OnRamps dual enrollment course;
86	86	(xi) students who successfully completed a
87	87	practicum or internship approved by the State Board of Education;
88	88	(xii) students who are awarded an associate
89	89	degree; and
90	90	(xiii) students who successfully completed
91	91	a program of study in career and technical education;
92	92	(2) in the school progress domain, indicators for
93	93	effectiveness in promoting student learning, which must include:
94	94	(A) for assessment instruments, including
95	95	assessment instruments under Subdivisions (1)(A)(i) and (ii), the
96	96	percentage of students who met the standard for improvement, as
97	97	determined by the commissioner; and
98	98	(B) for evaluating relative performance, the
99	99	performance of districts and campuses compared to similar districts
100	100	or campuses; and
101	101	(3) in the closing the gaps domain, the use of
102	102	disaggregated data to demonstrate the differentials among students
103	103	from different racial and ethnic groups, socioeconomic
104	104	backgrounds, and other factors, including:
105	105	(A) students formerly receiving special
106	106	education services;
107	107	(B) students continuously enrolled; and
108	108	(C) students who are mobile.
109	109	SECTION 2. This Act applies beginning with the 2023-2024
110	110	school year.
111	111	SECTION 3. This Act takes effect immediately if it receives
112	112	a vote of two-thirds of all the members elected to each house, as
113	113	provided by Section 39, Article III, Texas Constitution. If this
114	114	Act does not receive the vote necessary for immediate effect, this
115	115	Act takes effect September 1, 2023.
