55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an indicator of achievement for military readiness
88 under the public school accountability system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.053(c), Education Code, is amended to
1111 read as follows:
1212 (c) School districts and campuses must be evaluated based on
1313 three domains of indicators of achievement adopted under this
1414 section that include:
1515 (1) in the student achievement domain, indicators of
1616 student achievement that must include:
1717 (A) for evaluating the performance of districts
1818 and campuses generally:
1919 (i) an indicator that accounts for the
2020 results of assessment instruments required under Sections
2121 39.023(a), (c), and (l), as applicable for the district and campus,
2222 including the results of assessment instruments required for
2323 graduation retaken by a student, aggregated across grade levels by
2424 subject area, including:
2525 (a) for the performance standard
2626 determined by the commissioner under Section 39.0241(a), the
2727 percentage of students who performed satisfactorily on the
2828 assessment instruments, aggregated across grade levels by subject
2929 area; and
3030 (b) for the college readiness
3131 performance standard as determined under Section 39.0241, the
3232 percentage of students who performed satisfactorily on the
3333 assessment instruments, aggregated across grade levels by subject
3434 area; and
3535 (ii) an indicator that accounts for the
3636 results of assessment instruments required under Section
3737 39.023(b), as applicable for the district and campus, including the
3838 percentage of students who performed satisfactorily on the
3939 assessment instruments, as determined by the performance standard
4040 adopted by the agency, aggregated across grade levels by subject
4141 area; and
4242 (B) for evaluating the performance of high school
4343 campuses and districts that include high school campuses,
4444 indicators that account for:
4545 (i) students who satisfy the Texas Success
4646 Initiative (TSI) college readiness benchmarks prescribed by the
4747 Texas Higher Education Coordinating Board under Section 51.334 on
4848 an assessment instrument in reading or mathematics designated by
4949 the coordinating board under that section;
5050 (ii) students who satisfy relevant
5151 performance standards on advanced placement tests or similar
5252 assessments;
5353 (iii) students who earn dual course credits
5454 in the dual credit courses;
5555 (iv) students who demonstrate military
5656 readiness by:
5757 (a) enlisting [enlist] in the armed
5858 forces of the United States or the Texas National Guard;
5959 (b) achieving a passing score set by
6060 the applicable military branch on the Armed Services Vocational
6161 Aptitude Battery test; or
6262 (c) successfully completing a Junior
6363 Reserve Officer Training Corps program;
6464 (v) students who earn industry
6565 certifications;
6666 (vi) students admitted into postsecondary
6767 industry certification programs that require as a prerequisite for
6868 entrance successful performance at the secondary level;
6969 (vii) students whose successful completion
7070 of a course or courses under Section 28.014 indicates the student's
7171 preparation to enroll and succeed, without remediation, in an
7272 entry-level general education course for a baccalaureate degree or
7373 associate degree;
7474 (viii) students who successfully met
7575 standards on a composite of indicators that through research
7676 indicates the student's preparation to enroll and succeed, without
7777 remediation, in an entry-level general education course for a
7878 baccalaureate degree or associate degree;
7979 (ix) high school graduation rates, computed
8080 in accordance with standards and definitions adopted in compliance
8181 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
8282 subject to the exclusions provided by Subsections (g), (g-1),
8383 (g-2), (g-3), and (g-4);
8484 (x) students who successfully completed an
8585 OnRamps dual enrollment course;
8686 (xi) students who successfully completed a
8787 practicum or internship approved by the State Board of Education;
8888 (xii) students who are awarded an associate
8989 degree; and
9090 (xiii) students who successfully completed
9191 a program of study in career and technical education;
9292 (2) in the school progress domain, indicators for
9393 effectiveness in promoting student learning, which must include:
9494 (A) for assessment instruments, including
9595 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
9696 percentage of students who met the standard for improvement, as
9797 determined by the commissioner; and
9898 (B) for evaluating relative performance, the
9999 performance of districts and campuses compared to similar districts
100100 or campuses; and
101101 (3) in the closing the gaps domain, the use of
102102 disaggregated data to demonstrate the differentials among students
103103 from different racial and ethnic groups, socioeconomic
104104 backgrounds, and other factors, including:
105105 (A) students formerly receiving special
106106 education services;
107107 (B) students continuously enrolled; and
108108 (C) students who are mobile.
109109 SECTION 2. This Act applies beginning with the 2023-2024
110110 school year.
111111 SECTION 3. This Act takes effect immediately if it receives
112112 a vote of two-thirds of all the members elected to each house, as
113113 provided by Section 39, Article III, Texas Constitution. If this
114114 Act does not receive the vote necessary for immediate effect, this
115115 Act takes effect September 1, 2023.
