| 7 | 7 | | relating to the temporary appointment of county jailers. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1701.310, Occupations Code, is amended |
|---|
| 10 | 10 | | by amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (b) A county jailer appointed on a temporary basis who does |
|---|
| 13 | 13 | | not satisfactorily complete the preparatory training program |
|---|
| 14 | 14 | | before the first anniversary of the date that the person is |
|---|
| 15 | 15 | | appointed shall be removed from the position. A county jailer |
|---|
| 16 | 16 | | appointed on a temporary basis shall be enrolled in the preparatory |
|---|
| 17 | 17 | | training program on or before the 90th day after their temporary |
|---|
| 18 | 18 | | appointment. A temporary appointment may not be renewed, except |
|---|
| 19 | 19 | | that the sheriff may petition the commission to extend the |
|---|
| 20 | 20 | | temporary appointment for a period not to exceed six months. |
|---|
| 21 | 21 | | (b-1) A person who has previously been appointed on a |
|---|
| 22 | 22 | | temporary basis as a county jailer and separated from that position |
|---|
| 23 | 23 | | may not be subsequently appointed on a temporary basis as a county |
|---|
| 24 | 24 | | jailer at the same or a different county jail unless the person was |
|---|
| 25 | 25 | | in good standing at the time the person separated from the position. |
|---|
| 26 | 26 | | A temporary appointment under this subsection may not exceed one |
|---|
| 27 | 27 | | year. |
|---|
| 28 | 28 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 29 | 29 | | of this Act, the Texas Commission on Law Enforcement shall adopt the |
|---|
| 30 | 30 | | rules necessary to implement the changes in law made by this Act to |
|---|
| 31 | 31 | | Section 1701.310, Occupations Code. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
