77 relating to the temporary appointment of county jailers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1701.310, Occupations Code, is amended
1010 by amending Subsection (b) and adding Subsection (b-1) to read as
1111 follows:
1212 (b) A county jailer appointed on a temporary basis who does
1313 not satisfactorily complete the preparatory training program
1414 before the first anniversary of the date that the person is
1515 appointed shall be removed from the position. A county jailer
1616 appointed on a temporary basis shall be enrolled in the preparatory
1717 training program on or before the 90th day after their temporary
1818 appointment. A temporary appointment may not be renewed, except
1919 that the sheriff may petition the commission to extend the
2020 temporary appointment for a period not to exceed six months.
2121 (b-1) A person who has previously been appointed on a
2222 temporary basis as a county jailer and separated from that position
2323 may not be subsequently appointed on a temporary basis as a county
2424 jailer at the same or a different county jail unless the person was
2525 in good standing at the time the person separated from the position.
2626 A temporary appointment under this subsection may not exceed one
2727 year.
2828 SECTION 2. As soon as practicable after the effective date
2929 of this Act, the Texas Commission on Law Enforcement shall adopt the
3030 rules necessary to implement the changes in law made by this Act to
3131 Section 1701.310, Occupations Code.
3232 SECTION 3. This Act takes effect September 1, 2023.
