7 | 7 | | relating to the permissible use of the school safety allotment |
---|
8 | 8 | | under the Foundation School Program for certain mental health |
---|
9 | 9 | | services. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 48.115(b), Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (b) Funds allocated under this section must be used to |
---|
14 | 14 | | improve school safety and security, including costs associated |
---|
15 | 15 | | with: |
---|
16 | 16 | | (1) securing school facilities, including: |
---|
17 | 17 | | (A) improvements to school infrastructure; |
---|
18 | 18 | | (B) the use or installation of physical barriers; |
---|
19 | 19 | | and |
---|
20 | 20 | | (C) the purchase and maintenance of: |
---|
21 | 21 | | (i) security cameras or other security |
---|
22 | 22 | | equipment; and |
---|
23 | 23 | | (ii) technology, including communications |
---|
24 | 24 | | systems or devices, that facilitates communication and information |
---|
25 | 25 | | sharing between students, school personnel, and first responders in |
---|
26 | 26 | | an emergency; |
---|
27 | 27 | | (2) mental health services, including: |
---|
28 | 28 | | (A) programs relating to suicide prevention, |
---|
29 | 29 | | intervention, and postvention; |
---|
30 | 30 | | (B) telehealth and other related programs that |
---|
31 | 31 | | allow students and families to access mental health services from |
---|
32 | 32 | | licensed professionals; |
---|
33 | 33 | | (C) prevention and treatment programs relating |
---|
34 | 34 | | to addressing adverse childhood experiences; |
---|
35 | 35 | | (D) evidence-based, effective prevention |
---|
36 | 36 | | practices for the prevention, identification, and management of |
---|
37 | 37 | | emergencies and threats, including: |
---|
38 | 38 | | (i) providing licensed counselors, social |
---|
39 | 39 | | workers, and individuals trained in restorative discipline and |
---|
40 | 40 | | restorative justice practices; |
---|
41 | 41 | | (ii) providing other mental health |
---|
42 | 42 | | personnel and support; |
---|
43 | 43 | | (iii) providing behavioral health |
---|
44 | 44 | | services; |
---|
45 | 45 | | (iv) establishing threat reporting |
---|
46 | 46 | | systems; and |
---|
47 | 47 | | (v) developing and implementing programs |
---|
48 | 48 | | focused on restorative justice practices, culturally relevant |
---|
49 | 49 | | instruction, and mental health support; |
---|
50 | 50 | | (3) providing security for the district, including: |
---|
51 | 51 | | (A) employing school district peace officers, |
---|
52 | 52 | | private security officers, and school marshals; and |
---|
53 | 53 | | (B) collaborating with local law enforcement |
---|
54 | 54 | | agencies, such as entering into a memorandum of understanding for |
---|
55 | 55 | | the assignment of school resource officers to schools in the |
---|
56 | 56 | | district; and |
---|
57 | 57 | | (4) [(3)] school safety and security training and |
---|
58 | 58 | | planning, including[: |
---|
59 | 59 | | [(A)] active shooter and emergency response |
---|
60 | 60 | | training[; |
---|
61 | 61 | | [(B) prevention and treatment programs relating |
---|
62 | 62 | | to addressing adverse childhood experiences; and |
---|
63 | 63 | | [(C) the prevention, identification, and |
---|
64 | 64 | | management of emergencies and threats, using evidence-based, |
---|
65 | 65 | | effective prevention practices and including: |
---|
66 | 66 | | [(i) providing licensed counselors, social |
---|
67 | 67 | | workers, and individuals trained in restorative discipline and |
---|
68 | 68 | | restorative justice practices; |
---|
69 | 69 | | [(ii) providing mental health personnel and |
---|
70 | 70 | | support; |
---|
71 | 71 | | [(iii) providing behavioral health |
---|
72 | 72 | | services; |
---|
73 | 73 | | [(iv) establishing threat reporting |
---|
74 | 74 | | systems; and |
---|
75 | 75 | | [(v) developing and implementing programs |
---|
76 | 76 | | focused on restorative justice practices, culturally relevant |
---|
77 | 77 | | instruction, and providing mental health support; and |
---|
78 | 78 | | [(4) providing programs related to suicide |
---|
79 | 79 | | prevention, intervention, and postvention]. |
---|
80 | 80 | | SECTION 2. This Act takes effect September 1, 2023. |
