55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the permissible use of the school safety allotment
88 under the Foundation School Program for certain mental health
99 services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 48.115(b), Education Code, is amended to
1212 read as follows:
1313 (b) Funds allocated under this section must be used to
1414 improve school safety and security, including costs associated
1515 with:
1616 (1) securing school facilities, including:
1717 (A) improvements to school infrastructure;
1818 (B) the use or installation of physical barriers;
1919 and
2020 (C) the purchase and maintenance of:
2121 (i) security cameras or other security
2222 equipment; and
2323 (ii) technology, including communications
2424 systems or devices, that facilitates communication and information
2525 sharing between students, school personnel, and first responders in
2626 an emergency;
2727 (2) mental health services, including:
2828 (A) programs relating to suicide prevention,
2929 intervention, and postvention;
3030 (B) telehealth and other related programs that
3131 allow students and families to access mental health services from
3232 licensed professionals;
3333 (C) prevention and treatment programs relating
3434 to addressing adverse childhood experiences;
3535 (D) evidence-based, effective prevention
3636 practices for the prevention, identification, and management of
3737 emergencies and threats, including:
3838 (i) providing licensed counselors, social
3939 workers, and individuals trained in restorative discipline and
4040 restorative justice practices;
4141 (ii) providing other mental health
4242 personnel and support;
4343 (iii) providing behavioral health
4444 services;
4545 (iv) establishing threat reporting
4646 systems; and
4747 (v) developing and implementing programs
4848 focused on restorative justice practices, culturally relevant
4949 instruction, and mental health support;
5050 (3) providing security for the district, including:
5151 (A) employing school district peace officers,
5252 private security officers, and school marshals; and
5353 (B) collaborating with local law enforcement
5454 agencies, such as entering into a memorandum of understanding for
5555 the assignment of school resource officers to schools in the
5656 district; and
5757 (4) [(3)] school safety and security training and
5858 planning, including[:
5959 [(A)] active shooter and emergency response
6060 training[;
6161 [(B) prevention and treatment programs relating
6262 to addressing adverse childhood experiences; and
6363 [(C) the prevention, identification, and
6464 management of emergencies and threats, using evidence-based,
6565 effective prevention practices and including:
6666 [(i) providing licensed counselors, social
6767 workers, and individuals trained in restorative discipline and
6868 restorative justice practices;
6969 [(ii) providing mental health personnel and
7070 support;
7171 [(iii) providing behavioral health
7272 services;
7373 [(iv) establishing threat reporting
7474 systems; and
7575 [(v) developing and implementing programs
7676 focused on restorative justice practices, culturally relevant
7777 instruction, and providing mental health support; and
7878 [(4) providing programs related to suicide
7979 prevention, intervention, and postvention].
8080 SECTION 2. This Act takes effect September 1, 2023.
