| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 42.0421, Human Resources Code, is |
|---|
| 9 | 9 | | amended by adding Subsection (g-1) to read as follows: |
|---|
| 10 | 10 | | (g-1) Notwithstanding Subsection (g), a person who is the |
|---|
| 11 | 11 | | director of a day-care center may provide training under this |
|---|
| 12 | 12 | | section regardless of whether the commission imposed an |
|---|
| 13 | 13 | | administrative penalty under Section 42.078 against the day-care |
|---|
| 14 | 14 | | center if the person was not the director of the day-care center at |
|---|
| 15 | 15 | | the time the commission imposed the penalty. |

| 16 | 16 | | SECTION 2. This Act takes effect September 1, 2023. |
