55 relating to the establishment of a living organ donor education

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
99 amended by adding Chapter 54 to read as follows:
1010 CHAPTER 54. LIVING ORGAN DONOR EDUCATION PROGRAM
1111 Sec. 54.001. ESTABLISHMENT OF PROGRAM. The department
1212 shall establish a living organ donor education program to educate
1313 residents of this state about:
1414 (1) the need for living organ donors, including the
1515 particular need for donors from minority populations;
1616 (2) the partnership between the Glenda Dawson Donate
1717 Life Texas Registry for deceased organ donation, maintained by
1818 Donate Life Texas, and other organ donor registries for living
1919 organ donation;
2020 (3) the requirements for registering as a potential
2121 living organ donor;
2222 (4) the medical screening and procedures necessary for
2323 an individual to be a living organ donor; and
2424 (5) the availability of information about living organ
2525 donation in health care facilities, transplant centers, organ
2626 procurement organizations, tissue banks, eye banks, and driver's
2727 license offices.
2828 Sec. 54.002. INFORMATIONAL MATERIALS. (a) The department,
2929 in consultation with Donate Life Texas, shall develop written and
3030 electronic informational materials, including links to Internet
3131 websites and machine-readable codes, regarding:
3232 (1) living organ donation; and
3333 (2) the process of registering with a living donor
3434 registry.
3535 (b) Donate Life Texas may develop and provide the
3636 informational materials described by Subsection (a) to the
3737 department.
3838 (c) The department and the Department of Public Safety shall
3939 post the information described by Subsection (a) on each of the
4040 agency's Internet websites.
4141 (d) Appropriate health care facilities, transplant centers,
4242 organ procurement organizations, tissue banks, eye banks, and
4343 driver's license offices may access the informational materials
4444 described by Subsection (a) on the Internet websites of the
4545 department and the Department of Public Safety and print the
4646 materials to place in their facilities or offices to provide to
4747 residents of this state.
4848 SECTION 2. As soon as practicable after the effective date
4949 of this Act, the Department of State Health Services shall
5050 establish the program and obtain the informational materials as
5151 required by Chapter 54, Health and Safety Code, as added by this
5252 Act.
5353 SECTION 3. This Act takes effect September 1, 2023.
