55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of disabled parking placards to certain
88 day activity and health services facilities that transport persons
99 with a disability.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 681.0032, Transportation Code, is
1212 amended to read as follows:
1313 Sec. 681.0032. ISSUANCE OF DISABLED PARKING PLACARDS TO
1414 CERTAIN INSTITUTIONS. (a) The department shall provide for the
1515 issuance of disabled parking placards described by Section 681.002
1616 for a van or bus operated by:
1717 (1) an institution, facility, or residential
1818 retirement community for the elderly in which a person eligible for
1919 a license plate under [described by] Section 504.201 [504.201(a)]
2020 resides, including an institution licensed under Chapter 242,
2121 Health and Safety Code, and a facility licensed under Chapter 246 or
2222 247 of that code; or
2323 (2) a day activity and health services facility
2424 licensed under Chapter 103, Human Resources Code, that provides
2525 services to a person eligible for a license plate under Section
2626 504.201.
2727 (b) The application for a disabled parking placard must be
2828 made in the manner provided by Section 681.003(b) and be
2929 accompanied by a written statement signed by the administrator or
3030 manager of, as applicable:
3131 (1) the institution, facility, or retirement
3232 community described by Subsection (a)(1) certifying to the
3333 department that the institution, facility, or retirement community
3434 regularly transports, as a part of the services that the
3535 institution, facility, or retirement community provides, one or
3636 more persons eligible for a license plate under [described by]
3737 Section 504.201 [504.201(a)] who reside in the institution,
3838 facility, or retirement community; or
3939 (2) the facility described by Subsection (a)(2)
4040 certifying to the department that the facility regularly
4141 transports, as a part of the services that the facility provides,
4242 one or more persons eligible for a license plate under Section
4343 504.201.
4444 (c) The department shall determine the eligibility of an
4545 [the] institution, facility, or retirement community for a disabled
4646 parking placard based on the evidence the applicant provides.
4747 SECTION 2. This Act takes effect September 1, 2023.
