| 7 | 7 | | relating to the issuance of disabled parking placards to certain |

| 8 | 8 | | day activity and health services facilities that transport persons |
|---|
| 9 | 9 | | with a disability. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 681.0032, Transportation Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 681.0032. ISSUANCE OF DISABLED PARKING PLACARDS TO |
|---|
| 14 | 14 | | CERTAIN INSTITUTIONS. (a) The department shall provide for the |
|---|
| 15 | 15 | | issuance of disabled parking placards described by Section 681.002 |
|---|
| 16 | 16 | | for a van or bus operated by: |
|---|
| 17 | 17 | | (1) an institution, facility, or residential |
|---|
| 18 | 18 | | retirement community for the elderly in which a person eligible for |
|---|
| 19 | 19 | | a license plate under [described by] Section 504.201 [504.201(a)] |
|---|
| 20 | 20 | | resides, including an institution licensed under Chapter 242, |
|---|
| 21 | 21 | | Health and Safety Code, and a facility licensed under Chapter 246 or |
|---|
| 22 | 22 | | 247 of that code; or |
|---|
| 23 | 23 | | (2) a day activity and health services facility |
|---|
| 24 | 24 | | licensed under Chapter 103, Human Resources Code, that provides |
|---|
| 25 | 25 | | services to a person eligible for a license plate under Section |
|---|
| 26 | 26 | | 504.201. |
|---|
| 27 | 27 | | (b) The application for a disabled parking placard must be |
|---|
| 28 | 28 | | made in the manner provided by Section 681.003(b) and be |
|---|
| 29 | 29 | | accompanied by a written statement signed by the administrator or |
|---|
| 30 | 30 | | manager of, as applicable: |
|---|
| 31 | 31 | | (1) the institution, facility, or retirement |
|---|
| 32 | 32 | | community described by Subsection (a)(1) certifying to the |
|---|
| 33 | 33 | | department that the institution, facility, or retirement community |
|---|
| 34 | 34 | | regularly transports, as a part of the services that the |
|---|
| 35 | 35 | | institution, facility, or retirement community provides, one or |
|---|
| 36 | 36 | | more persons eligible for a license plate under [described by] |
|---|
| 37 | 37 | | Section 504.201 [504.201(a)] who reside in the institution, |
|---|
| 38 | 38 | | facility, or retirement community; or |
|---|
| 39 | 39 | | (2) the facility described by Subsection (a)(2) |
|---|
| 40 | 40 | | certifying to the department that the facility regularly |
|---|
| 41 | 41 | | transports, as a part of the services that the facility provides, |
|---|
| 42 | 42 | | one or more persons eligible for a license plate under Section |
|---|
| 43 | 43 | | 504.201. |
|---|
| 44 | 44 | | (c) The department shall determine the eligibility of an |
|---|
| 45 | 45 | | [the] institution, facility, or retirement community for a disabled |
|---|
| 46 | 46 | | parking placard based on the evidence the applicant provides. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect September 1, 2023. |
