55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal penalty for certain offenses
88 committed in a disaster area or an evacuated area.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 12.50(b) and (c), Penal Code, are
1111 amended to read as follows:
1212 (b) The increase in punishment authorized by this section
1313 applies only to an offense under:
1414 (1) Section 20.05;
1515 (2) Section 20.06;
1616 (3) Section 20.07;
1717 (4) Section 22.01;
1818 (5) [(2)] Section 28.02;
1919 (6) [(3)] Section 29.02;
2020 (7) [(4)] Section 30.02;
2121 (8) [(5)] Section 30.03;
2222 (9) [(6)] Section 30.04;
2323 (10) [(7)] Section 30.05; and
2424 (11) [(8)] Section 31.03.
2525 (c) If an offense listed under Subsection (b) [(b)(1), (5),
2626 (6), (7), or (8)] is punishable as a Class A misdemeanor, the
2727 minimum term of confinement for the offense is increased to 180
2828 days. If an offense listed under Subsection (b) [(b)(2), (4), or
2929 (8)] is punishable as a felony of the first degree, the punishment
3030 for that offense may not be increased under this section.
3131 SECTION 2. The change in law made by this Act applies only
3232 to an offense committed on or after the effective date of this
3333 Act. An offense committed before the effective date of this Act is
3434 governed by the law in effect on the date the offense was committed,
3535 and the former law is continued in effect for that purpose. For
3636 purposes of this section, an offense was committed before the
3737 effective date of this Act if any element of the offense occurred
3838 before that date.
3939 SECTION 3. This Act takes effect September 1, 2023.
