55 relating to prompt payment deadlines for health benefit plan
66 claims affected by a catastrophic event.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 843.337, Insurance Code, is amended by
99 amending Subsections (b) and (c) and adding Subsection (c-1) to
1010 read as follows:
1111 (b) If a physician or provider fails to submit a claim in
1212 compliance with this section, the physician or provider forfeits
1313 the right to payment [unless the failure to submit the claim in
1414 compliance with this section is a result of a catastrophic event
1515 that substantially interferes with the normal business operations
1616 of the physician or provider].
1717 (c) The period for submitting a claim under this section may
1818 be extended by:
1919 (1) contract;
2020 (2) notice published by the commissioner allowing an
2121 extension of prompt payment deadlines to a later date chosen by the
2222 commissioner due to a catastrophic event; or
2323 (3) the department's approval of a physician's or
2424 provider's request for an extension due to a catastrophic event
2525 that substantially interferes with the normal business operations
2626 of the physician or provider.
2727 (c-1) The commissioner may adopt rules to implement
2828 Subsection (c), including rules establishing requirements for a
2929 request made under Subsection (c)(3).
3030 SECTION 2. Section 843.342(h), Insurance Code, is amended
3131 to read as follows:
3232 (h) A health maintenance organization is not liable for a
3333 penalty under this section:
3434 (1) if the failure to pay the claim in accordance with
3535 this subchapter is a result of a catastrophic event and:
3636 (A) the commissioner published a notice allowing
3737 an extension of the applicable prompt payment deadlines due to the
3838 catastrophic event; or
3939 (B) the department approved the health
4040 maintenance organization's request for an extension due to the
4141 substantial interference of the catastrophic event [that
4242 substantially interferes] with the normal business operations of
4343 the health maintenance organization; or
4444 (2) if the claim was paid in accordance with this
4545 subchapter, but for less than the contracted rate, and:
4646 (A) the physician or provider notifies the health
4747 maintenance organization of the underpayment after the 270th day
4848 after the date the underpayment was received; and
4949 (B) the health maintenance organization pays the
5050 balance of the claim on or before the 30th day after the date the
5151 health maintenance organization receives the notice.
5252 SECTION 3. Section 1301.102, Insurance Code, is amended by
5353 amending Subsections (d) and (e) and adding Subsection (e-1) to
5454 read as follows:
5555 (d) If a physician or health care provider fails to submit a
5656 claim in compliance with this section, the physician or provider
5757 forfeits the right to payment [unless the failure to submit the
5858 claim in compliance with this section is a result of a catastrophic
5959 event that substantially interferes with the normal business
6060 operations of the physician or provider].
6161 (e) The period for submitting a claim under this section may
6262 be extended by:
6363 (1) contract;
6464 (2) notice published by the commissioner allowing an
6565 extension of prompt payment deadlines to a later date chosen by the
6666 commissioner due to a catastrophic event; or
6767 (3) the department's approval of a physician's or
6868 health care provider's request for an extension due to a
6969 catastrophic event that substantially interferes with the normal
7070 business operations of the physician or provider.
7171 (e-1) The commissioner may adopt rules to implement
7272 Subsection (e), including rules establishing requirements for a
7373 request made under Subsection (e)(3).
7474 SECTION 4. Section 1301.137(h), Insurance Code, is amended
7575 to read as follows:
7676 (h) An insurer is not liable for a penalty under this
7777 section:
7878 (1) if the failure to pay the claim in accordance with
7979 Subchapter C is a result of a catastrophic event and:
8080 (A) the commissioner published a notice allowing
8181 an extension of the applicable prompt payment deadlines due to the
8282 catastrophic event; or
8383 (B) the department approved the insurer's
8484 request for an extension due to the substantial interference of the
8585 catastrophic event [that substantially interferes] with the normal
8686 business operations of the insurer; or
8787 (2) if the claim was paid in accordance with
8888 Subchapter C, but for less than the contracted rate, and:
8989 (A) the preferred provider notifies the insurer
9090 of the underpayment after the 270th day after the date the
9191 underpayment was received; and
9292 (B) the insurer pays the balance of the claim on
9393 or before the 30th day after the date the insurer receives the
9494 notice.
9595 SECTION 5. The changes in law made by this Act apply only to
9696 a claim submitted on or after the effective date of this Act. A
9797 claim submitted before the effective date of this Act is governed by
9898 the law as it existed immediately before the effective date of this
9999 Act, and that law is continued in effect for that purpose.
100100 SECTION 6. This Act takes effect September 1, 2023.
