| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
|---|
| 8 | 8 | | by adding Section 26.02715 to read as follows: |
|---|
| 9 | 9 | | Sec. 26.02715. DISPOSAL OF RECLAIMED WASTEWATER TO |
|---|
| 10 | 10 | | WASTEWATER COLLECTION SYSTEM. (a) A wastewater treatment facility |
|---|
| 11 | 11 | | or reclaimed water production facility that treats domestic |
|---|
| 12 | 12 | | wastewater for reuse may dispose of the treated wastewater without |
|---|
| 13 | 13 | | a permit for an alternative means of disposal if the facility: |
|---|
| 14 | 14 | | (1) disposes of the treated wastewater through a |
|---|
| 15 | 15 | | wastewater collection system; and |
|---|
| 16 | 16 | | (2) has the consent of the operator of: |
|---|
| 17 | 17 | | (A) the wastewater collection system that will |
|---|
| 18 | 18 | | receive the treated wastewater; and |
|---|
| 19 | 19 | | (B) any wastewater treatment facility that will |
|---|
| 20 | 20 | | further treat the treated wastewater. |
|---|
| 21 | 21 | | (b) The owner of a reclaimed water production facility that |
|---|
| 22 | 22 | | meets the requirements of Subsection (a) may not be required to be |
|---|
| 23 | 23 | | the owner of an associated domestic wastewater treatment facility |
|---|
| 24 | 24 | | that is permitted by the commission. |
|---|
| 25 | 25 | | (c) The commission shall adopt rules to implement and |
|---|
| 26 | 26 | | enforce this section. |
|---|
| 27 | 27 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 28 | 28 | | of this Act, the Texas Commission on Environmental Quality shall |
|---|
| 29 | 29 | | adopt the rules required by Section 26.02715, Water Code, as added |
|---|
| 30 | 30 | | by this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2023. |
