55 relating to the prosecution and punishment for possession or
66 promotion of child pornography; increasing criminal penalties.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Article 12.01, Code of Criminal Procedure, is
99 amended to read as follows:
1010 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1111 felony indictments may be presented within these limits, and not
1212 afterward:
1313 (1) no limitation:
1414 (A) murder and manslaughter;
1515 (B) sexual assault under Section 22.011(a)(2),
1616 Penal Code, or aggravated sexual assault under Section
1717 22.021(a)(1)(B), Penal Code;
1818 (C) sexual assault, if:
1919 (i) during the investigation of the offense
2020 biological matter is collected and the matter:
2121 (a) has not yet been subjected to
2222 forensic DNA testing; or
2323 (b) has been subjected to forensic DNA
2424 testing and the testing results show that the matter does not match
2525 the victim or any other person whose identity is readily
2626 ascertained; or
2727 (ii) probable cause exists to believe that
2828 the defendant has committed the same or a similar sex offense
2929 against five or more victims;
3030 (D) continuous sexual abuse of young child or
3131 disabled individual under Section 21.02, Penal Code;
3232 (E) indecency with a child under Section 21.11,
3333 Penal Code;
3434 (F) an offense involving leaving the scene of an
3535 accident under Section 550.021, Transportation Code, if the
3636 accident resulted in the death of a person;
3737 (G) trafficking of persons under Section
3838 20A.02(a)(7) or (8), Penal Code;
3939 (H) continuous trafficking of persons under
4040 Section 20A.03, Penal Code; or
4141 (I) compelling prostitution under Section
4242 43.05(a)(2), Penal Code;
4343 (2) ten years from the date of the commission of the
4444 offense:
4545 (A) theft of any estate, real, personal or mixed,
4646 by an executor, administrator, guardian or trustee, with intent to
4747 defraud any creditor, heir, legatee, ward, distributee,
4848 beneficiary or settlor of a trust interested in such estate;
4949 (B) theft by a public servant of government
5050 property over which the public servant exercises control in the
5151 public servant's official capacity;
5252 (C) forgery or the uttering, using, or passing of
5353 forged instruments;
5454 (D) injury to an elderly or disabled individual
5555 punishable as a felony of the first degree under Section 22.04,
5656 Penal Code;
5757 (E) sexual assault, except as provided by
5858 Subdivision (1) or (7);
5959 (F) arson;
6060 (G) trafficking of persons under Section
6161 20A.02(a)(1), (2), (3), or (4), Penal Code; or
6262 (H) compelling prostitution under Section
6363 43.05(a)(1), Penal Code;
6464 (3) seven years from the date of the commission of the
6565 offense:
6666 (A) misapplication of fiduciary property or
6767 property of a financial institution;
6868 (B) fraudulent securing of document execution;
6969 (C) a felony violation under Chapter 162, Tax
7070 Code;
7171 (D) false statement to obtain property or credit
7272 under Section 32.32, Penal Code;
7373 (E) money laundering;
7474 (F) credit card or debit card abuse under Section
7575 32.31, Penal Code;
7676 (G) fraudulent use or possession of identifying
7777 information under Section 32.51, Penal Code;
7878 (H) exploitation of a child, elderly individual,
7979 or disabled individual under Section 32.53, Penal Code;
8080 (I) health care fraud under Section 35A.02, Penal
8181 Code; [or]
8282 (J) bigamy under Section 25.01, Penal Code,
8383 except as provided by Subdivision (6); or
8484 (K) possession or promotion of child pornography
8585 under Section 43.26, Penal Code;
8686 (4) five years from the date of the commission of the
8787 offense:
8888 (A) theft or robbery;
8989 (B) except as provided by Subdivision (5),
9090 kidnapping or burglary;
9191 (C) injury to an elderly or disabled individual
9292 that is not punishable as a felony of the first degree under Section
9393 22.04, Penal Code;
9494 (D) abandoning or endangering a child; or
9595 (E) insurance fraud;
9696 (5) if the investigation of the offense shows that the
9797 victim is younger than 17 years of age at the time the offense is
9898 committed, 20 years from the 18th birthday of the victim of one of
9999 the following offenses:
100100 (A) sexual performance by a child under Section
101101 43.25, Penal Code;
102102 (B) aggravated kidnapping under Section
103103 20.04(a)(4), Penal Code, if the defendant committed the offense
104104 with the intent to violate or abuse the victim sexually; or
105105 (C) burglary under Section 30.02, Penal Code, if
106106 the offense is punishable under Subsection (d) of that section and
107107 the defendant committed the offense with the intent to commit an
108108 offense described by Subdivision (1)(B) or (D) of this article or
109109 Paragraph (B) of this subdivision;
110110 (6) ten years from the 18th birthday of the victim of
111111 the offense:
112112 (A) trafficking of persons under Section
113113 20A.02(a)(5) or (6), Penal Code;
114114 (B) injury to a child under Section 22.04, Penal
115115 Code; or
116116 (C) bigamy under Section 25.01, Penal Code, if
117117 the investigation of the offense shows that the person, other than
118118 the legal spouse of the defendant, whom the defendant marries or
119119 purports to marry or with whom the defendant lives under the
120120 appearance of being married is younger than 18 years of age at the
121121 time the offense is committed;
122122 (7) two years from the date the offense was
123123 discovered: sexual assault punishable as a state jail felony under
124124 Section 22.011(f)(2), Penal Code; or
125125 (8) three years from the date of the commission of the
126126 offense: all other felonies.
127127 SECTION 2. Section 43.26, Penal Code, is amended by
128128 amending Subsection (d) and adding Subsection (d-1) to read as
129129 follows:
130130 (d) An offense under Subsection (a) is:
131131 (1) a felony of the third degree if the person
132132 possesses visual material that contains fewer than 100 visual
133133 depictions of a child as described by Subsection (a)(1);
134134 (2) [, except that the offense is:
135135 [(1)] a felony of the second degree if [it is shown on
136136 the trial of the offense that] the person possesses visual material
137137 that contains 100 or more visual depictions of a child as described
138138 by Subsection (a)(1) but fewer than 500 such depictions [has been
139139 previously convicted one time of an offense under that subsection];
140140 (3) [and
141141 [(2)] a felony of the first degree if [it is shown on the
142142 trial of the offense that] the person possesses visual material
143143 that contains 500 or more visual depictions of a child as described
144144 by Subsection (a)(1); or
145145 (4) a felony of the first degree punishable by
146146 imprisonment in the Texas Department of Criminal Justice for life
147147 or for any term of not more than 99 years or less than 25 years if it
148148 is shown on the trial of the offense that, at the time of the
149149 offense, the person was:
150150 (A) an employee at a child-care facility or a
151151 residential child-care facility, as those terms are defined by
152152 Section 42.002, Human Resources Code;
153153 (B) an employee at a residential treatment
154154 facility established under Section 221.056, Human Resources Code;
155155 (C) an employee at a shelter or facility that
156156 serves youth and that receives state funds; or
157157 (D) receiving state funds for the care of a child
158158 depicted by the visual material [has been previously convicted two
159159 or more times of an offense under that subsection].
160160 (d-1) If it is shown on the trial of an offense under
161161 Subsection (a) that the visual material depicted a child younger
162162 than 10 years of age at the time the image of the child was made or
163163 that the defendant has been previously convicted of an offense
164164 under that subsection:
165165 (1) an offense described for purposes of punishment by
166166 Subsection (d)(1) or (2) is increased to the next higher category of
167167 offense; or
168168 (2) the minimum term of confinement for an offense
169169 described for purposes of punishment by Subsection (d)(3) is
170170 increased to 15 years.
171171 SECTION 3. Article 12.01, Code of Criminal Procedure, as
172172 amended by this Act, does not apply to an offense if the prosecution
173173 of that offense becomes barred by limitation before the effective
174174 date of this Act. The prosecution of that offense remains barred as
175175 if this Act had not taken effect.
176176 SECTION 4. Section 43.26, Penal Code, as amended by this
177177 Act, applies only to an offense committed on or after the effective
178178 date of this Act. An offense committed before the effective date of
179179 this Act is governed by the law in effect on the date the offense was
180180 committed, and the former law is continued in effect for that
181181 purpose. For purposes of this section, an offense was committed
182182 before the effective date of this Act if any element of the offense
183183 occurred before that date.
184184 SECTION 5. To the extent of any conflict, this Act prevails
185185 over another Act of the 88th Legislature, Regular Session, 2023,
186186 relating to nonsubstantive additions to and corrections in enacted
187187 codes.
188188 SECTION 6. This Act takes effect September 1, 2023.
