| 7 | 7 | | relating to the provision of information regarding distributed |

| 8 | 8 | | generation and certain electrical loads. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.9165, Utilities Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 39.9165. DISTRIBUTED GENERATION FACILITY REPORTING. |
|---|
| 13 | 13 | | (a) In this section, "distributed generation facility" |
|---|
| 14 | 14 | | [generation"] is an electrical generating facility, including an |
|---|
| 15 | 15 | | energy storage facility, that: |
|---|
| 16 | 16 | | (1) [may be located at a customer's point of delivery; |
|---|
| 17 | 17 | | [(2)] is connected at a voltage less than 60 |
|---|
| 18 | 18 | | kilovolts; and |
|---|
| 19 | 19 | | (2) is capable of being [(3) may be] connected in |
|---|
| 20 | 20 | | parallel operation to the utility system. |
|---|
| 21 | 21 | | (b) An independent organization certified under Section |
|---|
| 22 | 22 | | 39.151 may [shall] require an owner or operator of a distributed |
|---|
| 23 | 23 | | generation facility operating in the power region served by the |
|---|
| 24 | 24 | | independent organization to provide information about the |
|---|
| 25 | 25 | | distributed generation facility, as specified by the independent |
|---|
| 26 | 26 | | organization, to the owner's or operator's [to register with the |
|---|
| 27 | 27 | | organization and] interconnecting electric cooperative, |
|---|
| 28 | 28 | | municipally owned utility, or transmission and distribution |
|---|
| 29 | 29 | | utility [information necessary for the interconnection of the |
|---|
| 30 | 30 | | distributed generator]. |
|---|
| 31 | 31 | | (c) An independent organization certified under Section |
|---|
| 32 | 32 | | 39.151 may require each electric cooperative, municipally owned |
|---|
| 33 | 33 | | utility, and transmission and distribution utility operating in the |
|---|
| 34 | 34 | | power region served by the independent organization to provide to |
|---|
| 35 | 35 | | the independent organization any information about distributed |
|---|
| 36 | 36 | | generation facilities or distribution-connected loads in the |
|---|
| 37 | 37 | | service territory of the electric cooperative, municipally owned |
|---|
| 38 | 38 | | utility, or transmission and distribution utility that the |
|---|
| 39 | 39 | | independent organization identifies as necessary for maintaining |
|---|
| 40 | 40 | | system reliability. |
|---|
| 41 | 41 | | (d) The commission may require an owner or operator of a |
|---|
| 42 | 42 | | distributed generation facility or an electric cooperative, |
|---|
| 43 | 43 | | municipally owned utility, or transmission and distribution |
|---|
| 44 | 44 | | utility to provide the information described by Subsections (b) and |
|---|
| 45 | 45 | | (c). |
|---|
| 46 | 46 | | (e) The commission or an independent organization certified |
|---|
| 47 | 47 | | under Section 39.151 may require information described by |
|---|
| 48 | 48 | | Subsections (b) and (c) to be provided on an individual basis or on |
|---|
| 49 | 49 | | an aggregated basis [This section does not apply to distributed |
|---|
| 50 | 50 | | generation serving a residential property]. |
|---|
| 51 | 51 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 52 | 52 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 53 | 53 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 54 | 54 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 55 | 55 | | Act takes effect September 1, 2023. |
