55 AN ACT
66 relating to the state salary for retired judges.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1.0n the effective date of this Act, the Employees
99 Retirement System of Texas shall recompute the annuities of persons
1010 who retired before September 1, 2019, as if the retiree's salary on
1111 the date of retirement was that of a judge or justice who has eight
1212 years and 1 day of service as of September 1, 2019 and is of the same
1313 classification as the last court to which the retiree was elected or
1414 appointed. On the effective date of this Act, the retirement system
1515 shall also recompute the annuities of beneficiaries receiving an
1616 annuity that became payable before that date under Sections 839.301
1717 or 839.302, Government Code, in the same manner.
1818 SECTION 2. In the event the 88th Legislature enacts
1919 legislation increasing the state salary of district or appellate
2020 judges or justices or authorizes a state salary increase for
2121 district or appellate judges or justices in the General
2222 Appropriations Act, on the effective date of the salary increase,
2323 the Employees Retirement System of Texas shall recompute the
2424 annuities of persons who retired before the effective date of the
2525 salary increase under Sections 839.102 or 839.103, Government Code,
2626 as if the retiree's salary on the date of retirement was that of a
2727 judge or justice who has eight years and 1 day of service and is of
2828 the same classification as the last court to which the retiree was
2929 elected or appointed. On the effective date of a state salary
3030 increase described by this Act, the retirement system shall also
3131 recompute the annuities of beneficiaries receiving an annuity that
3232 became payable before that date under Sections 839.301 or 839.302,
3333 Government Code, in the same manner.
3434 SECTION 2. This Act takes effect September 1, 2023.
