| 6 | 6 | | relating to the state salary for retired judges. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1.0n the effective date of this Act, the Employees |
|---|
| 9 | 9 | | Retirement System of Texas shall recompute the annuities of persons |
|---|
| 10 | 10 | | who retired before September 1, 2019, as if the retiree's salary on |
|---|
| 11 | 11 | | the date of retirement was that of a judge or justice who has eight |
|---|
| 12 | 12 | | years and 1 day of service as of September 1, 2019 and is of the same |
|---|
| 13 | 13 | | classification as the last court to which the retiree was elected or |
|---|
| 14 | 14 | | appointed. On the effective date of this Act, the retirement system |
|---|
| 15 | 15 | | shall also recompute the annuities of beneficiaries receiving an |
|---|
| 16 | 16 | | annuity that became payable before that date under Sections 839.301 |
|---|
| 17 | 17 | | or 839.302, Government Code, in the same manner. |
|---|
| 18 | 18 | | SECTION 2. In the event the 88th Legislature enacts |
|---|
| 19 | 19 | | legislation increasing the state salary of district or appellate |
|---|
| 20 | 20 | | judges or justices or authorizes a state salary increase for |
|---|
| 21 | 21 | | district or appellate judges or justices in the General |
|---|
| 22 | 22 | | Appropriations Act, on the effective date of the salary increase, |
|---|
| 23 | 23 | | the Employees Retirement System of Texas shall recompute the |
|---|
| 24 | 24 | | annuities of persons who retired before the effective date of the |
|---|
| 25 | 25 | | salary increase under Sections 839.102 or 839.103, Government Code, |
|---|
| 26 | 26 | | as if the retiree's salary on the date of retirement was that of a |
|---|
| 27 | 27 | | judge or justice who has eight years and 1 day of service and is of |
|---|
| 28 | 28 | | the same classification as the last court to which the retiree was |
|---|
| 29 | 29 | | elected or appointed. On the effective date of a state salary |
|---|
| 30 | 30 | | increase described by this Act, the retirement system shall also |
|---|
| 31 | 31 | | recompute the annuities of beneficiaries receiving an annuity that |
|---|
| 32 | 32 | | became payable before that date under Sections 839.301 or 839.302, |
|---|
| 33 | 33 | | Government Code, in the same manner. |

| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2023. |
