| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 1, Education Code, is amended by adding |
|---|
| 12 | 12 | | Section 1.008 to read as follows: |
|---|
| 13 | 13 | | Sec. 1.008. RESTRICTION ON ENTITIES THAT MAY PROVIDE |
|---|
| 14 | 14 | | CERTAIN TRAINING AND CONTRACTS TO PUBLIC EDUCATIONAL INSTITUTIONS. |

| 15 | 15 | | A nonprofit state association or organization that primarily |
|---|
| 16 | 16 | | represents school boards of trustees or other public educational |
|---|
| 17 | 17 | | institutions and adopts as part of its mission statement or |
|---|
| 18 | 18 | | organizing principles a concept described by Section |
|---|
| 19 | 19 | | 28.0022(a)(4)(A) may not provide directly or by subsidiary or |
|---|
| 20 | 20 | | contract with a third party to a public primary or secondary school |
|---|
| 21 | 21 | | in this state, the Texas Education Agency, or a regional education |
|---|
| 22 | 22 | | service center: |
|---|
| 23 | 23 | | (1) any training or instruction; or |
|---|
| 24 | 24 | | (2) contracts of any value for insurance or |
|---|
| 25 | 25 | | participation in a risk pool. |
|---|
| 26 | 26 | | SECTION 2. Section 1.008, Education Code, as added by this |
|---|
| 27 | 27 | | Act, applies only to a contract entered into on or after the |
|---|
| 28 | 28 | | effective date of this Act. A contract entered into before the |
|---|
| 29 | 29 | | effective date of this Act is governed by the law in effect on the |
|---|
| 30 | 30 | | date the contract was entered into, and the former law is continued |
|---|
| 31 | 31 | | in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
