55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to enhancing the criminal penalty for the offense of
88 intoxication manslaughter in certain circumstances.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 49.09(b-2), Penal Code, is amended to
1111 read as follows:
1212 (b-2) An offense under Section 49.08 is:
1313 (1) a felony of the first degree if it is shown on the
1414 trial of the offense that the person caused the death of a person
1515 described by Subsection (b-1);
1616 (2) a felony of the first degree punishable by
1717 imprisonment in the Texas Department of Criminal Justice for life
1818 if:
1919 (A) the actor committed the offense when younger
2020 than 18 years of age; and
2121 (B) it is shown on the trial of the offense that:
2222 (i) the actor was restricted to the
2323 operation of a motor vehicle equipped with an ignition interlock
2424 device under Article 17.441, Code of Criminal Procedure, Article
2525 42A.408, Code of Criminal Procedure, Section 521.246,
2626 Transportation Code, or Subsection (h) of this section; and
2727 (ii) during the commission of the offense
2828 the actor, in violation of the order restricting the actor to the
2929 operation of a motor vehicle equipped with an ignition interlock
3030 device, operated a motor vehicle not equipped with the device or a
3131 motor vehicle equipped with a device that the individual knew was
3232 circumvented or otherwise not functioning; or
3333 (3) a felony of the first degree punishable by
3434 imprisonment in the Texas Department of Criminal Justice for life
3535 without parole if:
3636 (A) the actor committed the offense when 18 years
3737 of age or older; and
3838 (B) it is shown on the trial of the offense that:
3939 (i) the actor was restricted to the
4040 operation of a motor vehicle equipped with an ignition interlock
4141 device under Article 17.441, Code of Criminal Procedure, Article
4242 42A.408, Code of Criminal Procedure, Section 521.246,
4343 Transportation Code, or Subsection (h) of this section; and
4444 (ii) during the commission of the offense
4545 the actor, in violation of the order restricting the actor to the
4646 operation of a motor vehicle equipped with an ignition interlock
4747 device, operated a motor vehicle not equipped with the device or a
4848 motor vehicle equipped with a device that the individual knew was
4949 circumvented or otherwise not functioning.
5050 SECTION 2. Section 49.09(c), Penal Code, is amended by
5151 adding Subdivision (5) to read as follows:
5252 (5) "Ignition interlock device" has the meaning
5353 assigned by Article 42A.408, Code of Criminal Procedure.
5454 SECTION 3. The changes in law made by this Act apply only to
5555 an offense committed on or after the effective date of this Act. An
5656 offense committed before the effective date of this Act is governed
5757 by the law in effect on the date the offense was committed, and the
5858 former law is continued in effect for that purpose. For purposes of
5959 this section, an offense was committed before the effective date of
6060 this Act if any element of the offense occurred before that date.
6161 SECTION 4. This Act takes effect September 1, 2023.
