66 AN ACT
77 relating to a requirement that certain students, interns,
88 residents, and fellows receiving a clinical education at public or
99 nonprofit hospitals receive an annual comprehensive health
1010 examination.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 312.004(d), Health and Safety Code, is
1313 amended to read as follows:
1414 (d) Except as otherwise provided by this chapter, the [The]
1515 contracting parties may determine the terms of and the
1616 consideration for a contract authorized under this section.
1717 SECTION 2. Chapter 312, Health and Safety Code, is amended
1818 by adding Section 312.0045 to read as follows:
1919 Sec. 312.0045. REQUIRED CONTRACT PROVISION: HEALTH
2020 EXAMINATION. A contract under Section 312.004 must require each
2121 student, intern, resident, and fellow who is enrolled at a
2222 contracting medical or dental unit or supported medical or dental
2323 school and who is receiving a clinical education at a public or
2424 nonprofit hospital to undergo at least one comprehensive health
2525 examination each year. The public or nonprofit hospital at which
2626 the student, intern, resident, or fellow is receiving the clinical
2727 education must offer to provide the examination at no charge and
2828 provide the student, intern, resident, or fellow with a day off on
2929 which to receive the examination. A public or nonprofit hospital
3030 may not reduce the amount of the compensation paid by the hospital
3131 to the student, intern, resident, or fellow, if any, for time off
3232 taken for the examination.
3333 SECTION 3. The change in law made by this Act applies only
3434 to a contract entered into on or after the effective date of this
3535 Act. A contract entered into before the effective date of this Act
3636 is governed by the law in effect on the date the contract was
3737 entered into, and the former law is continued in effect for that
3838 purpose.
3939 SECTION 4. This Act takes effect September 1, 2023.
