| 9 | 9 | | nonprofit hospitals receive an annual comprehensive health |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 312.004(d), Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (d) Except as otherwise provided by this chapter, the [The] |
|---|
| 15 | 15 | | contracting parties may determine the terms of and the |
|---|
| 16 | 16 | | consideration for a contract authorized under this section. |
|---|
| 17 | 17 | | SECTION 2. Chapter 312, Health and Safety Code, is amended |
|---|
| 18 | 18 | | by adding Section 312.0045 to read as follows: |
|---|
| 19 | 19 | | Sec. 312.0045. REQUIRED CONTRACT PROVISION: HEALTH |
|---|
| 20 | 20 | | EXAMINATION. A contract under Section 312.004 must require each |
|---|
| 21 | 21 | | student, intern, resident, and fellow who is enrolled at a |
|---|
| 22 | 22 | | contracting medical or dental unit or supported medical or dental |
|---|
| 23 | 23 | | school and who is receiving a clinical education at a public or |
|---|
| 24 | 24 | | nonprofit hospital to undergo at least one comprehensive health |
|---|
| 25 | 25 | | examination each year. The public or nonprofit hospital at which |
|---|
| 26 | 26 | | the student, intern, resident, or fellow is receiving the clinical |
|---|
| 27 | 27 | | education must offer to provide the examination at no charge and |
|---|
| 28 | 28 | | provide the student, intern, resident, or fellow with a day off on |
|---|
| 29 | 29 | | which to receive the examination. A public or nonprofit hospital |
|---|
| 30 | 30 | | may not reduce the amount of the compensation paid by the hospital |
|---|
| 31 | 31 | | to the student, intern, resident, or fellow, if any, for time off |
|---|
| 32 | 32 | | taken for the examination. |
|---|
| 33 | 33 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 34 | 34 | | to a contract entered into on or after the effective date of this |
|---|
| 35 | 35 | | Act. A contract entered into before the effective date of this Act |
|---|
| 36 | 36 | | is governed by the law in effect on the date the contract was |
|---|
| 37 | 37 | | entered into, and the former law is continued in effect for that |
|---|
| 38 | 38 | | purpose. |
|---|
| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2023. |
