| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 32.003, Estates Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (a-1) to read as follows: |
|---|
| 13 | 13 | | (a-1) A party to a probate proceeding may not file a motion |
|---|
| 14 | 14 | | for the assignment of a statutory probate court judge to hear a |
|---|
| 15 | 15 | | contested matter in the proceeding before the 10th day after the |
|---|
| 16 | 16 | | date a party has notified the judge of the county court of the |
|---|
| 17 | 17 | | contested matter. |

| 18 | 18 | | SECTION 2. Section 32.003(c), Estates Code, is repealed. |

| 19 | 19 | | SECTION 3. Section 32.003, Estates Code, as amended by this |
|---|
| 20 | 20 | | Act, applies only to an action filed or other proceeding commenced |
|---|
| 21 | 21 | | on or after the effective date of this Act. An action filed or other |
|---|
| 22 | 22 | | proceeding commenced before the effective date of this Act is |
|---|
| 23 | 23 | | governed by the law in effect on the date the action was filed or the |
|---|
| 24 | 24 | | proceeding was commenced, and the former law is continued in effect |
|---|
| 25 | 25 | | for that purpose. |
|---|
| 26 | 26 | | SECTION 4. This Act takes effect September 1, 2023. |
