44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the Medicaid eligibility of certain women after a
77 pregnancy.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 32.024, Human Resources Code, is amended
1010 by adding Subsection (l-1) to read as follows:
1111 (l-1) The commission shall continue to provide medical
1212 assistance to a woman who is eligible for medical assistance for
1313 pregnant women for a period of not less than 12 months following the
1414 date the woman delivers or experiences an involuntary miscarriage.
1515 SECTION 2. If before implementing any provision of this Act
1616 a state agency determines that a waiver or authorization from a
1717 federal agency is necessary for implementation of that provision,
1818 the agency affected by the provision shall request the waiver or
1919 authorization and may delay implementing that provision until the
2020 waiver or authorization is granted.
2121 SECTION 3. This Act takes effect September 1, 2021.
