55 relating to the local development agreement database maintained by
66 the comptroller of public accounts.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 403.0246(a)(2), Government Code, is
99 amended to read as follows:
1010 (2) "Local development agreement" means:
1111 (A) an agreement entered into by a municipality
1212 under Section 380.001 or 380.002, Local Government Code;
1313 (B) an agreement entered into by a county under
1414 Section 381.004, Local Government Code; [or]
1515 (C) an agreement entered into by a local
1616 government under Chapter 312, Tax Code; or
1717 (D) any other agreement to grant or otherwise
1818 commit public money or other resources for economic development
1919 purposes by a local government under Chapter 380 or 381, Local
2020 Government Code.
2121 SECTION 2. Section 403.0246, Government Code, is amended by
2222 amending Subsections (b) and (c) and adding Subsection (h) to read
2323 as follows:
2424 (b) The comptroller shall create and make accessible on the
2525 Internet a consolidated searchable data tool [database], to be
2626 known as the Local Development [Chapter 380 and 381] Agreement
2727 Database, that contains information regarding all local
2828 development agreements in this state.
2929 (c) For each local development agreement described by
3030 Subsection (b), the database must include:
3131 (1) the name of the local government that entered into
3232 the agreement;
3333 (2) a numerical code assigned to the local government
3434 by the comptroller;
3535 (3) the address of the local government's
3636 administrative offices and public contact information;
3737 (4) the name of the appropriate officer or other
3838 person representing the local government and that person's contact
3939 information;
4040 (5) the name and contact information of any entity or
4141 the entity's agent that entered into the agreement with the local
4242 government, including the business address and any assumed names of
4343 the entity;
4444 (6) the date on which the agreement went into effect
4545 and the date and terms on which the agreement expires;
4646 (7) the focus or scope of the agreement;
4747 (8) an electronic copy of the agreement; [and]
4848 (9) the name and contact information of the individual
4949 reporting the information to the comptroller;
5050 (10) the total monetary value of the agreement; and
5151 (11) the source of the money used or type of tax
5252 implicated by the agreement, including a sales and use tax, ad
5353 valorem tax, or hotel occupancy tax.
5454 (h) The comptroller may prescribe the form and manner in
5555 which a local government must submit information under Subsection
5656 (c).
5757 SECTION 3. Subchapter A, Chapter 312, Tax Code, is amended
5858 by adding Section 312.008 to read as follows:
5959 Sec. 312.008. INTERNET LINK TO AGREEMENT. A taxing unit
6060 that maintains an Internet website and that executes a tax
6161 abatement agreement under this chapter shall provide on the website
6262 a direct link to the location of the agreement information
6363 published on the comptroller's Internet website under Section
6464 403.0246, Government Code.
6565 SECTION 4. The changes in law made by this Act apply only to
6666 an agreement entered into on or after the effective date of this
6767 Act. An agreement entered into before the effective date of this
6868 Act is governed by the law in effect on the date the agreement is
6969 entered into, and the former law is continued in effect for that
7070 purpose.
7171 SECTION 5. This Act takes effect January 1, 2024.
