5	5	relating to the prosecution of certain littering offenses.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Section 365.012, Health and Safety Code, is
8	8	amended by adding Subsection (t) to read as follows:
9	9	(t) Chapter 15, Penal Code, applies to an offense under this
10	10	section.
11	11	SECTION 2. The changes in law made by this Act apply only to
12	12	an offense committed on or after the effective date of this Act. An
13	13	offense committed before the effective date of this Act is governed
14	14	by the law in effect on the date the offense was committed, and the
15	15	former law is continued in effect for that purpose. For purposes of
16	16	this section, an offense was committed before the effective date of
17	17	this Act if any element of the offense occurred before that date.
18	18	SECTION 3. This Act takes effect September 1, 2023.
