| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 531.09936 to read as follows: |
|---|
| 13 | 13 | | Sec. 531.09936. GRANT PROGRAM TO FUND MENTAL AND BEHAVIORAL |
|---|
| 14 | 14 | | HEALTH SERVICES BY CERTAIN CHILDREN'S HOSPITALS. (a) In this |
|---|
| 15 | 15 | | section: |
|---|
| 16 | 16 | | (1) "Children's hospital" means a hospital designated |
|---|
| 17 | 17 | | by the Centers for Medicare and Medicaid Services as a children's |
|---|
| 18 | 18 | | hospital that is exempted by that federal agency from payment under |
|---|
| 19 | 19 | | the inpatient prospective payment system under Medicare. |
|---|
| 20 | 20 | | (2) "Grant program" means the grant program |
|---|
| 21 | 21 | | established under Subsection (b). |
|---|
| 22 | 22 | | (b) To the extent funds are appropriated to the commission |
|---|
| 23 | 23 | | for that purpose, the commission shall establish a grant program |
|---|
| 24 | 24 | | under which the commission provides grants to children's hospitals |
|---|
| 25 | 25 | | for the purpose of supporting and expanding the provision of mental |
|---|
| 26 | 26 | | and behavioral health services to children in this state. A grant |
|---|
| 27 | 27 | | awarded under the grant program may be a: |
|---|
| 28 | 28 | | (1) planning grant; |
|---|
| 29 | 29 | | (2) development grant; |
|---|
| 30 | 30 | | (3) capital improvement grant; or |
|---|
| 31 | 31 | | (4) grant for transitional operating support. |
|---|
| 32 | 32 | | (c) A children's hospital may apply for a grant under the |
|---|
| 33 | 33 | | grant program in the form and manner prescribed by the commission. |
|---|
| 34 | 34 | | (d) A grant recipient may use a grant awarded under the |
|---|
| 35 | 35 | | grant program only to increase the recipient's capacity to provide |
|---|
| 36 | 36 | | mental and behavioral health care services to children in this |
|---|
| 37 | 37 | | state. The commission shall monitor and evaluate the use of money |
|---|
| 38 | 38 | | awarded under the grant program to ensure compliance with this |
|---|
| 39 | 39 | | subsection. |
|---|
| 40 | 40 | | (e) Not later than December 1 of each even-numbered year, |
|---|
| 41 | 41 | | the commission shall submit a biennial report to the legislature on |
|---|
| 42 | 42 | | the performance of the grant program during the preceding two state |
|---|
| 43 | 43 | | fiscal years. The report must include the name of each grant |
|---|
| 44 | 44 | | recipient awarded a grant under the program and the amount of the |
|---|
| 45 | 45 | | recipient's award during the fiscal years covered by the report. |
|---|
| 46 | 46 | | SECTION 2. This Act takes effect September 1, 2023. |
