66 AN ACT
77 relating to a grant program to fund the provision by children's
88 hospitals of mental and behavioral health services to children in
99 this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.09936 to read as follows:
1313 Sec. 531.09936. GRANT PROGRAM TO FUND MENTAL AND BEHAVIORAL
1414 HEALTH SERVICES BY CERTAIN CHILDREN'S HOSPITALS. (a) In this
1515 section:
1616 (1) "Children's hospital" means a hospital designated
1717 by the Centers for Medicare and Medicaid Services as a children's
1818 hospital that is exempted by that federal agency from payment under
1919 the inpatient prospective payment system under Medicare.
2020 (2) "Grant program" means the grant program
2121 established under Subsection (b).
2222 (b) To the extent funds are appropriated to the commission
2323 for that purpose, the commission shall establish a grant program
2424 under which the commission provides grants to children's hospitals
2525 for the purpose of supporting and expanding the provision of mental
2626 and behavioral health services to children in this state. A grant
2727 awarded under the grant program may be a:
2828 (1) planning grant;
2929 (2) development grant;
3030 (3) capital improvement grant; or
3131 (4) grant for transitional operating support.
3232 (c) A children's hospital may apply for a grant under the
3333 grant program in the form and manner prescribed by the commission.
3434 (d) A grant recipient may use a grant awarded under the
3535 grant program only to increase the recipient's capacity to provide
3636 mental and behavioral health care services to children in this
3737 state. The commission shall monitor and evaluate the use of money
3838 awarded under the grant program to ensure compliance with this
3939 subsection.
4040 (e) Not later than December 1 of each even-numbered year,
4141 the commission shall submit a biennial report to the legislature on
4242 the performance of the grant program during the preceding two state
4343 fiscal years. The report must include the name of each grant
4444 recipient awarded a grant under the program and the amount of the
4545 recipient's award during the fiscal years covered by the report.
4646 SECTION 2. This Act takes effect September 1, 2023.
