66 AN ACT
77 relating to training materials for certain transportation network
88 company drivers regarding human trafficking awareness and
99 prevention.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 2402, Occupations Code, is
1212 amended by adding Section 2402.1075 to read as follows:
1313 Sec. 2402.1075. HUMAN TRAFFICKING AWARENESS AND PREVENTION
1414 TRAINING MATERIALS REQUIRED. (a) A transportation network company
1515 shall annually provide to each driver who is authorized to log in to
1616 the company's digital network human trafficking awareness and
1717 prevention training materials. The training materials must:
1818 (1) be provided in a digital video format or
1919 Internet-based video format;
2020 (2) be not less than 15 minutes in duration;
2121 (3) be approved by the attorney general;
2222 (4) be provided in English and Spanish;
2323 (5) be provided to a new driver before the driver is
2424 authorized to provide prearranged rides using the company's digital
2525 network; and
2626 (6) include:
2727 (A) an overview of human trafficking, including a
2828 description of:
2929 (i) the experience of human trafficking
3030 victims;
3131 (ii) how and why human trafficking takes
3232 place in the transportation industry; and
3333 (iii) how human trafficking is defined
3434 under state and federal law;
3535 (B) guidance on how to identify individuals who
3636 are most at risk for human trafficking;
3737 (C) information on the difference between labor
3838 and sex trafficking as that relates to identification of human
3939 trafficking in the transportation industry;
4040 (D) guidance on the role of a driver in reporting
4141 and responding to human trafficking; and
4242 (E) the contact information of appropriate
4343 entities for reporting human trafficking, including:
4444 (i) the National Human Trafficking Hotline
4545 toll-free telephone number and text line;
4646 (ii) appropriate law enforcement agencies;
4747 and
4848 (iii) a telephone number designated by the
4949 attorney general for reporting suspected human trafficking.
5050 (b) A transportation network company shall maintain records
5151 necessary to establish that the company has provided the training
5252 materials required by this section.
5353 SECTION 2. This Act takes effect September 1, 2023.
