66 AN ACT
77 relating to a counseling and crisis management program for relative
88 or other designated caregivers and children in the managing
99 conservatorship of the Department of Family and Protective
1010 Services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter I, Chapter 264, Family Code, is
1313 amended by adding Section 264.7553 to read as follows:
1414 Sec. 264.7553. COUNSELING AND CRISIS MANAGEMENT PROGRAM FOR
1515 RELATIVE OR OTHER DESIGNATED CAREGIVER PLACEMENTS. (a) The
1616 department shall develop a counseling and crisis management program
1717 to provide mental and behavioral telehealth services and mobile
1818 mental and behavioral health intervention services to relative or
1919 other designated caregivers and children in the managing
2020 conservatorship of the department who are placed with relative or
2121 other designated caregivers.
2222 (b) Mental and behavioral telehealth services provided
2323 under this section must be:
2424 (1) accessible electronically through the use of a
2525 computer or telephone application; and
2626 (2) available 24 hours a day, seven days a week.
2727 (c) Mobile mental and behavioral health intervention
2828 services provided under this section must be:
2929 (1) deployed to the location of the child or the
3030 relative or other designated caregiver requiring intervention
3131 services; and
3232 (2) available 24 hours a day, seven days a week.
3333 (d) Services described by this section may only be provided
3434 by:
3535 (1) a licensed psychologist;
3636 (2) a licensed marriage and family therapist, as
3737 defined by Section 502.002, Occupations Code;
3838 (3) a licensed professional counselor, as defined by
3939 Section 503.002, Occupations Code;
4040 (4) a licensed clinical social worker, as defined by
4141 Section 505.002, Occupations Code; or
4242 (5) any similarly qualified mental health
4343 professional as established by department rule.
4444 (e) The department shall, to the extent possible, seek
4545 reimbursement from the medical assistance program under Chapter 32,
4646 Human Resources Code, or a health plan that provides health
4747 coverage for services described by this section to relative or
4848 other designated caregivers and children.
4949 (f) The department may contract with an outside vendor to
5050 provide services described by this section.
5151 (g) The commissioner shall adopt rules necessary to
5252 implement this section.
5353 SECTION 2. (a) As soon as practicable after the effective
5454 date of this Act, the commissioner of the Department of Family and
5555 Protective Services shall adopt the rules necessary to implement
5656 Section 264.7553, Family Code, as added by this Act.
5757 (b) The Department of Family and Protective Services shall
5858 begin providing the services required under Section 264.7553,
5959 Family Code, as added by this Act, as follows:
6060 (1) mental and behavioral telehealth services, not
6161 later than January 1, 2024; and
6262 (2) mobile mental and behavioral health intervention
6363 services, not later than January 1, 2025.
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2023.
