| 5 | 5 | | relating to costs associated with the destruction of certain deer. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 43.955, Parks and Wildlife Code, is |
|---|
| 8 | 8 | | amended to read as follows: |
|---|
| 9 | 9 | | Sec. 43.955. COST OF ASSESSMENT AND DESTRUCTION OF DEER |
|---|
| 10 | 10 | | [RECOVERY]. (a) The applicable permit holder shall pay all costs |
|---|
| 11 | 11 | | associated with: |
|---|
| 12 | 12 | | (1) an epidemiological assessment conducted under |
|---|
| 13 | 13 | | this subchapter to the animal health commission; and |
|---|
| 14 | 14 | | (2) except as provided by Subsection (b), the |
|---|
| 15 | 15 | | destruction of deer under this subchapter to the department. |
|---|
| 16 | 16 | | (b) Except as provided by Subsection (c), the department |
|---|
| 17 | 17 | | shall waive the costs associated with the destruction under this |
|---|
| 18 | 18 | | subchapter of breeder deer at a facility covered by a permit issued |
|---|
| 19 | 19 | | under Subchapter L where a breeder deer has tested positive for |
|---|
| 20 | 20 | | chronic wasting disease in a test performed by a testing laboratory |
|---|
| 21 | 21 | | accredited by the Animal and Plant Health Inspection Service of the |
|---|
| 22 | 22 | | United States Department of Agriculture. |
|---|
| 23 | 23 | | (c) The department may not waive costs under Subsection (b) |
|---|
| 24 | 24 | | if the department determines that the permit holder or an agent of |
|---|
| 25 | 25 | | the permit holder, in violation of this chapter or a regulation of |
|---|
| 26 | 26 | | the commission, caused: |
|---|
| 27 | 27 | | (1) the introduction of chronic wasting disease into |
|---|
| 28 | 28 | | the facility; or |
|---|
| 29 | 29 | | (2) a delay in the detection of chronic wasting |
|---|
| 30 | 30 | | disease at the facility. |
|---|
| 31 | 31 | | SECTION 2. Section 43.955, Parks and Wildlife Code, as |
|---|
| 32 | 32 | | amended by this Act, applies only to the payment of costs arising |
|---|
| 33 | 33 | | from the destruction of deer commenced on or after the effective |
|---|
| 34 | 34 | | date of this Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2023. |
