1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to dynamic message signs used in certain statewide alert
1414 systems.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Chapter 411, Government Code, is amended by adding
1717 Subchapter K-2 to read as follows:
1818 SUBCHAPTER K-2. DYNAMIC MESSAGE SIGNS FOR ALERT SYSTEMS
1919 Sec. 411.321. DYNAMIC MESSAGE SIGNS. (a) Except as
2020 provided by Subsection (c), the Texas Department of Transportation
2121 shall provide information necessary for statewide alert systems
2222 created under Subchapters K-1, L, L-1, M, P, P-1, and Q through a
2323 system of dynamic message signs that are:
2424 (1) located across the state; and
2525 (2) capable of displaying digital images useful in
2626 locating a missing individual.
2727 (b) The Texas Department of Transportation may enter into an
2828 agreement with a private entity to install or operate the dynamic
2929 message signs described by Subsection (a) and shall request from
3030 the Federal Highway Administration for any provisions necessary for
3131 implementation with the private entity. An agreement under this
3232 subsection must generate net revenue to the state and reduce the
3333 amount of tax revenue necessary to fund the installation and
3434 operation of the dynamic message signs described by Subsection (a).
3535 The Texas Department of Transportation may accept gifts and grants
3636 of money, equipment, or other resources necessary to install and
3737 operate the dynamic message signs described by Subsection (a).
3838 (c) The Texas Department of Transportation is not required
3939 to comply with Subsection (a) if that department receives notice
4040 from the United States Department of Transportation Federal Highway
4141 Administration that the use of the dynamic message signs described
4242 by that subsection would result in the loss of federal highway
4343 funding or other punitive actions taken against this state due to
4444 noncompliance with federal laws, regulations, or policies.
4545 SECTION 2. This Act takes effect September 1, 2023.
