15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 16 | | SECTION 1. Chapter 411, Government Code, is amended by adding |
---|
17 | 17 | | Subchapter K-2 to read as follows: |

18 | 18 | | SUBCHAPTER K-2. DYNAMIC MESSAGE SIGNS FOR ALERT SYSTEMS |
---|
19 | 19 | | Sec. 411.321. DYNAMIC MESSAGE SIGNS. (a) Except as |
---|
20 | 20 | | provided by Subsection (c), the Texas Department of Transportation |
---|
21 | 21 | | shall provide information necessary for statewide alert systems |
---|
22 | 22 | | created under Subchapters K-1, L, L-1, M, P, P-1, and Q through a |
---|
23 | 23 | | system of dynamic message signs that are: |
---|
24 | 24 | | (1) located across the state; and |
---|
25 | 25 | | (2) capable of displaying digital images useful in |
---|
26 | 26 | | locating a missing individual. |
---|
27 | 27 | | (b) The Texas Department of Transportation may enter into an |
---|
28 | 28 | | agreement with a private entity to install or operate the dynamic |
---|
29 | 29 | | message signs described by Subsection (a) and shall request from |
---|
30 | 30 | | the Federal Highway Administration for any provisions necessary for |
---|
31 | 31 | | implementation with the private entity. An agreement under this |
---|
32 | 32 | | subsection must generate net revenue to the state and reduce the |
---|
33 | 33 | | amount of tax revenue necessary to fund the installation and |
---|
34 | 34 | | operation of the dynamic message signs described by Subsection (a). |
---|
35 | 35 | | The Texas Department of Transportation may accept gifts and grants |
---|
36 | 36 | | of money, equipment, or other resources necessary to install and |
---|
37 | 37 | | operate the dynamic message signs described by Subsection (a). |
---|
38 | 38 | | (c) The Texas Department of Transportation is not required |
---|
39 | 39 | | to comply with Subsection (a) if that department receives notice |
---|
40 | 40 | | from the United States Department of Transportation Federal Highway |
---|
41 | 41 | | Administration that the use of the dynamic message signs described |
---|
42 | 42 | | by that subsection would result in the loss of federal highway |
---|
43 | 43 | | funding or other punitive actions taken against this state due to |
---|
44 | 44 | | noncompliance with federal laws, regulations, or policies. |
---|
45 | 45 | | SECTION 2. This Act takes effect September 1, 2023. |
