| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 162.304, Family Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (b-3) to read as follows: |
|---|
| 12 | 12 | | (b-3) The department may enter into an adoption assistance |
|---|
| 13 | 13 | | agreement for a child after a court has entered a final order of |
|---|
| 14 | 14 | | adoption if the child: |
|---|
| 15 | 15 | | (1) after the adoption is finalized, is diagnosed by |
|---|
| 16 | 16 | | the child's health care provider as having special needs; and |
|---|
| 17 | 17 | | (2) would have qualified for adoption assistance under |
|---|
| 18 | 18 | | Subsection (a) if the child was determined to have special needs |
|---|
| 19 | 19 | | before the adoption. |
|---|
| 20 | 20 | | SECTION 2. The changes in law made by this Act apply to an |
|---|
| 21 | 21 | | adoption for which the final order is rendered before, on, or after |
|---|
| 22 | 22 | | the effective date of this Act. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
