| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 162.304, Family Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (k) to read as follows: |
|---|
| 13 | 13 | | (k) The department shall annually review the process the |
|---|
| 14 | 14 | | department uses to enter into adoption assistance agreements under |
|---|
| 15 | 15 | | this section. As part of its review, the department shall consider: |
|---|
| 16 | 16 | | (1) the amount of money the department has available |
|---|
| 17 | 17 | | for adoption assistance agreements; |
|---|
| 18 | 18 | | (2) the maximum amount the department is authorized to |
|---|
| 19 | 19 | | pay as a subsidy under this section and the factors the department |
|---|
| 20 | 20 | | considers in determining that amount; and |
|---|
| 21 | 21 | | (3) the factors the department considers in |
|---|
| 22 | 22 | | determining a child's eligibility for a subsidy under this section. |

| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
