55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the continuation and functions of the Office of
88 State-Federal Relations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 751.003, Government Code, is amended to
1111 read as follows:
1212 Sec. 751.003. SUNSET PROVISION. The Office of
1313 State-Federal Relations is subject to Chapter 325 (Texas Sunset
1414 Act). Unless continued in existence as provided by that chapter,
1515 the office is abolished [and this chapter expires] September 1,
1616 2035 [2023].
1717 SECTION 2. Section 751.005, Government Code, is amended by
1818 amending Subsection (b) and adding Subsection (f) to read as
1919 follows:
2020 (b) The office shall:
2121 (1) help coordinate state and federal programs dealing
2222 with the same subject;
2323 (2) inform the governor and the legislature of federal
2424 programs that may be carried out in the state or that affect state
2525 programs;
2626 (3) provide federal agencies and the United States
2727 Congress with information about state policy and state conditions
2828 on matters that concern the federal government;
2929 (4) provide the legislature with information useful in
3030 measuring the effect of federal actions on the state and local
3131 programs;
3232 (5) prepare and supply to the governor and all members
3333 of the legislature an annual report that:
3434 (A) describes the office's operations;
3535 (B) contains the office's priorities and
3636 strategies for the following year;
3737 (C) details projects and legislation pursued by
3838 the office; and
3939 (D) discusses issues in the following
4040 congressional session of interest to this state; [and
4141 [(E) contains an analysis of federal funds
4242 availability and formulae;]
4343 (6) notify the governor, the lieutenant governor, the
4444 speaker of the house of representatives, and the legislative
4545 standing committees in each house with primary jurisdiction over
4646 intergovernmental affairs of federal activities relevant to the
4747 state and inform the Texas congressional delegation of state
4848 activities;
4949 (7) conduct frequent conference calls with the
5050 lieutenant governor and the speaker of the house of representatives
5151 or their designees regarding state-federal relations and programs;
5252 (8) respond to requests for information from the
5353 legislature, the United States Congress, and federal agencies;
5454 (9) coordinate with the Legislative Budget Board
5555 regarding the effects of federal funding on the state budget; and
5656 (10) report to, and on request send appropriate
5757 representatives to appear before, the legislative standing
5858 committees in each house with primary jurisdiction over
5959 intergovernmental affairs.
6060 (f) The office shall post the report required under
6161 Subsection (b)(5) to the office's publicly accessible Internet
6262 website.
6363 SECTION 3. The following provisions of the Government Code
6464 are repealed:
6565 (1) the heading to Subchapter A, Chapter 751; and
6666 (2) Subchapter B, Chapter 751.
6767 SECTION 4. This Act takes effect September 1, 2023.
