| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter B, Chapter 372, |

| 11 | 11 | | Transportation Code, is amended to read as follows: |

| 12 | 12 | | SUBCHAPTER B. TOLL PROJECT OPERATION; LIMITATION ON TOLL |

| 14 | 14 | | SECTION 2. Subchapter B, Chapter 372, Transportation Code, |

| 15 | 15 | | is amended by adding Section 372.059 to read as follows: |

| 16 | 16 | | Sec. 372.059. TOLLS PROHIBITED ON PORTION OF INTERSTATE |

| 17 | 17 | | HIGHWAY 635. The department may not charge a toll, either directly |
|---|
| 18 | 18 | | or indirectly through an agreement with another toll project |
|---|
| 19 | 19 | | entity, on the portion of Interstate Highway 635 between its |
|---|
| 20 | 20 | | intersection with Interstate Highway 30 and its intersection with |
|---|
| 21 | 21 | | U.S. Highway 75. |

| 22 | 22 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
