55 relating to disbursements from the universal service fund for
66 certain small and rural companies.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 56.032, Utilities Code, is amended by
99 adding Subsections (d-1) and (d-2) and amending Subsection (n) to
1010 read as follows:
1111 (d-1) In addition to the report required by Subsection (d),
1212 a small provider that submits a request under Subsection (c) shall
1313 file with the commission annually a report that includes the
1414 following information regarding the provider's operations that are
1515 regulated by the commission:
1616 (1) total operating revenues;
1717 (2) total operating expenses;
1818 (3) total operating tax expense;
1919 (4) rate of return;
2020 (5) total invested capital; and
2121 (6) network access revenue.
2222 (d-2) A small provider shall file the report required by
2323 Subsection (d-1) using the commission's public filing system.
2424 Subsection (k) does not apply to information in a report filed under
2525 Subsection (d-1).
2626 (n) Subsections (a), (c), (d), (e), (f), (g), (h), (i), (j),
2727 (k), (l), and (m) and any monthly amounts approved under those
2828 subsections expire September 1, 2033 [2023].
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
