| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 56.032, Utilities Code, is amended by |
|---|
| 9 | 9 | | adding Subsections (d-1) and (d-2) and amending Subsection (n) to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (d-1) In addition to the report required by Subsection (d), |
|---|
| 12 | 12 | | a small provider that submits a request under Subsection (c) shall |
|---|
| 13 | 13 | | file with the commission annually a report that includes the |
|---|
| 14 | 14 | | following information regarding the provider's operations that are |
|---|
| 15 | 15 | | regulated by the commission: |
|---|
| 16 | 16 | | (1) total operating revenues; |
|---|
| 17 | 17 | | (2) total operating expenses; |
|---|
| 18 | 18 | | (3) total operating tax expense; |
|---|
| 19 | 19 | | (4) rate of return; |
|---|
| 20 | 20 | | (5) total invested capital; and |
|---|
| 21 | 21 | | (6) network access revenue. |
|---|
| 22 | 22 | | (d-2) A small provider shall file the report required by |
|---|
| 23 | 23 | | Subsection (d-1) using the commission's public filing system. |
|---|
| 24 | 24 | | Subsection (k) does not apply to information in a report filed under |
|---|
| 25 | 25 | | Subsection (d-1). |
|---|
| 26 | 26 | | (n) Subsections (a), (c), (d), (e), (f), (g), (h), (i), (j), |
|---|
| 27 | 27 | | (k), (l), and (m) and any monthly amounts approved under those |
|---|
| 28 | 28 | | subsections expire September 1, 2033 [2023]. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
