66 AN ACT
77 relating to the authority of the attorney general to acquire by
88 eminent domain certain real property owned by aliens or foreign
99 entities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 4, Property Code, is amended by adding
1212 Chapter 21A to read as follows:
1313 CHAPTER 21A. ACQUISITION BY EMINENT DOMAIN OF CERTAIN
1414 FOREIGN-OWNED REAL PROPERTY
1515 Sec. 21A.001. DEFINITIONS. In this chapter:
1616 (1) "Alien" means a citizen of a country other than the
1717 United States.
1818 (2) "Critical infrastructure" means infrastructure in
1919 one of the following categories:
2020 (A) chemical;
2121 (B) commercial facilities;
2222 (C) communications;
2323 (D) critical manufacturing;
2424 (E) dams;
2525 (F) defense industrial bases;
2626 (G) emergency services;
2727 (H) energy;
2828 (I) financial services;
2929 (J) food and agriculture;
3030 (K) government facilities;
3131 (L) health care and public health;
3232 (M) information technology;
3333 (N) nuclear reactors, materials, and waste;
3434 (O) transportation systems; or
3535 (P) water and wastewater systems.
3636 (3) "Foreign" means created or organized in a country
3737 other than the United States or under the law of a country other
3838 than the United States.
3939 Sec. 21A.002. APPLICABILITY. This chapter applies to real
4040 property in this state that is owned by an alien, foreign business,
4141 or foreign government, or an agent, trustee, or fiduciary of an
4242 alien, foreign business, or foreign government.
4343 Sec. 21A.003. EMINENT DOMAIN; COURT PROCEEDING. (a) The
4444 attorney general may bring an action to obtain a court order under
4545 Subsection (c) authorizing the attorney general to initiate an
4646 eminent domain proceeding to acquire real property owned by an
4747 alien or foreign entity as described by Section 21A.002 if the
4848 attorney general has reason to believe and shows that the real
4949 property is being used in a manner that:
5050 (1) violates state or federal law; or
5151 (2) creates a risk to the state's critical
5252 infrastructure.
5353 (b) An action under this section may be brought in a
5454 district court in the county where all or part of the real property
5555 that is the subject of the action is located.
5656 (c) If the district court finds that the attorney general
5757 has made the showing required by Subsection (a), the court shall
5858 enter an order stating that finding.
5959 (d) On entry of the district court's order under Subsection
6060 (c), the attorney general may initiate eminent domain proceedings
6161 to acquire the real property.
6262 (e) Chapter 21 governs the procedure for an eminent domain
6363 proceeding initiated in accordance with this chapter. Chapter 2206,
6464 Government Code, and Subchapter E, Chapter 21, of this code do not
6565 apply to an eminent domain proceeding initiated in accordance with
6666 this chapter.
6767 Sec. 21A.004. STATE MANAGEMENT OF ACQUIRED REAL PROPERTY.
6868 Real property acquired by eminent domain under Section 21A.003
6969 shall be owned by this state and managed by the General Land Office.
7070 SECTION 2. As soon as practicable after the effective date
7171 of this Act, the attorney general shall adopt rules for the
7272 implementation of Chapter 21A, Property Code, as added by this Act.
7373 SECTION 3. This Act takes effect September 1, 2023.
