66 AN ACT
77 relating to the provision of certain information about Medicaid
88 benefits in relation to newborn children.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.0631 to read as follows:
1212 Sec. 32.0631. ANNUAL NOTICE TO CERTAIN PROVIDERS REGARDING
1313 USE OF MEDICAID IDENTIFICATION NUMBERS WITH RESPECT TO NEWBORN
1414 CHILDREN. The commission shall annually provide written notice to
1515 each health care provider who regularly provides health care
1616 services to Medicaid recipients who are pregnant women or newborn
1717 children:
1818 (1) reminding the providers that when a newborn child
1919 of a Medicaid recipient has not been assigned a Medicaid
2020 identification number, the provider may use the recipient's
2121 Medicaid identification number on any claim for reimbursement under
2222 Medicaid; and
2323 (2) encouraging providers to educate Medicaid
2424 recipients who are mothers or the prospective mothers of newborn
2525 children that the recipient may use the recipient's Medicaid
2626 identification number until the recipient's newborn child is
2727 enrolled in Medicaid.
2828 SECTION 2. Section 161.501(a), Health and Safety Code, is
2929 amended to read as follows:
3030 (a) A hospital, birthing center, physician, nurse midwife,
3131 or midwife who provides prenatal care to a pregnant woman during
3232 gestation or at delivery of an infant shall:
3333 (1) provide the woman and the father of the infant, if
3434 possible, or another adult caregiver for the infant, with a
3535 resource pamphlet that includes:
3636 (A) a list of the names, addresses, and phone
3737 numbers of professional organizations that provide postpartum
3838 counseling and assistance to parents relating to postpartum
3939 depression and other emotional trauma associated with pregnancy and
4040 parenting;
4141 (B) information regarding the prevention of
4242 shaken baby syndrome including:
4343 (i) techniques for coping with anger caused
4444 by a crying baby;
4545 (ii) different methods for preventing a
4646 person from shaking a newborn, infant, or other young child;
4747 (iii) the dangerous effects of shaking a
4848 newborn, infant, or other young child; and
4949 (iv) the symptoms of shaken baby syndrome
5050 and who to contact, as recommended by the American Academy of
5151 Pediatrics, if a parent suspects or knows that a baby has been
5252 shaken in order to receive prompt medical treatment;
5353 (C) a list of diseases for which a child is
5454 required by state law to be immunized and the appropriate schedule
5555 for the administration of those immunizations;
5656 (D) the appropriate schedule for follow-up
5757 procedures for newborn screening;
5858 (E) information regarding sudden infant death
5959 syndrome, including current recommendations for infant sleeping
6060 conditions to lower the risk of sudden infant death syndrome;
6161 (F) educational information in both English and
6262 Spanish on:
6363 (i) pertussis disease and the availability
6464 of a vaccine to protect against pertussis, including information on
6565 the Centers for Disease Control and Prevention recommendation that
6666 parents receive Tdap during the postpartum period to protect
6767 newborns from the transmission of pertussis; and
6868 (ii) the incidence of cytomegalovirus,
6969 birth defects caused by congenital cytomegalovirus, and available
7070 resources for the family of an infant born with congenital
7171 cytomegalovirus; [and]
7272 (G) the danger of heatstroke for a child left
7373 unattended in a motor vehicle; and
7474 (H) information about Medicaid benefits for
7575 children, including eligibility requirements and the process for
7676 applying for those benefits;
7777 (2) if the woman is a recipient of medical assistance
7878 under Chapter 32, Human Resources Code, provide the woman and the
7979 father of the infant, if possible, or another adult caregiver with a
8080 resource guide that includes information in both English and
8181 Spanish relating to the development, health, and safety of a child
8282 from birth until age five, including information relating to:
8383 (A) selecting and interacting with a primary
8484 health care practitioner and establishing a "medical home" for the
8585 child;
8686 (B) dental care;
8787 (C) effective parenting;
8888 (D) child safety;
8989 (E) the importance of reading to a child;
9090 (F) expected developmental milestones;
9191 (G) health care resources available in the state;
9292 (H) selecting appropriate child care; and
9393 (I) other resources available in the state;
9494 (3) document in the woman's record that the woman
9595 received the resource pamphlet described in Subdivision (1) and the
9696 resource guide described in Subdivision (2), if applicable; and
9797 (4) retain the documentation for at least five years
9898 in the hospital's, birthing center's, physician's, nurse midwife's,
9999 or midwife's records.
100100 SECTION 3. (a) Not later than December 1, 2023, the
101101 Department of State Health Services shall include the information
102102 required by Section 161.501(a)(1)(H), Health and Safety Code, as
103103 added by this Act, in the informational materials required by that
104104 section.
105105 (b) Notwithstanding Section 161.501(a)(1)(H), Health and
106106 Safety Code, as added by this Act, a hospital, birthing center,
107107 physician, nurse midwife, or midwife who provides prenatal care to
108108 a pregnant woman during gestation or at delivery of an infant is not
109109 required to comply with that provision until January 1, 2024.
110110 SECTION 4. This Act takes effect September 1, 2023.
