| 7 | 7 | | relating to access to the registry of persons who are not eligible |

| 8 | 8 | | for employment in public schools. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 22.092(d), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (d) The agency shall provide equivalent access to the |
|---|
| 13 | 13 | | registry maintained under this section to: |
|---|
| 14 | 14 | | (1) private schools; |
|---|
| 15 | 15 | | (2) public schools; [and] |
|---|
| 16 | 16 | | (3) child-care facilities and family homes licensed, |
|---|
| 17 | 17 | | registered, or listed under Chapter 42, Human Resources Code; and |
|---|
| 18 | 18 | | (4) nonprofit teacher organizations approved by the |
|---|
| 19 | 19 | | commissioner for the purpose of participating in the tutoring |
|---|
| 20 | 20 | | program established under Section 33.913. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2023. |
