9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 411, Government Code, is |
---|
11 | 11 | | amended by adding Section 411.0093 to read as follows: |
---|
12 | 12 | | Sec. 411.0093. RETAIL THEFT INVESTIGATION UNIT. (a) A |
---|
13 | 13 | | retail theft investigation unit is created within the department to |
---|
14 | 14 | | investigate and arrest individuals determined to have committed |
---|
15 | 15 | | retail theft and organized retail theft. |
---|
16 | 16 | | (b) The unit shall: |
---|
17 | 17 | | (1) on request, assist local law enforcement agencies |
---|
18 | 18 | | and prosecutors in the investigation and prosecution of retail |
---|
19 | 19 | | theft and organized retail theft committed in this state; and |
---|
20 | 20 | | (2) investigate organized retail theft committed in |
---|
21 | 21 | | this state by combinations and criminal street gangs, as those |
---|
22 | 22 | | terms are defined by Section 71.01, Penal Code. |
---|
23 | 23 | | (c) The unit may accept and use evidence of retail theft or |
---|
24 | 24 | | organized retail theft submitted by victims and other informants |
---|
25 | 25 | | for the purpose of investigating those offenses. |
---|
26 | 26 | | SECTION 2. The Department of Public Safety is required to |
---|
27 | 27 | | implement a provision of this Act only if the legislature |
---|
28 | 28 | | appropriates money specifically for that purpose. |
---|
29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
