77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 411, Government Code, is
99 amended by adding Section 411.02093 to read as follows:
1010 Sec. 411.02093. BORDER OPERATIONS TRAINING PROGRAM. (a)
1111 The department, in coordination with local law enforcement
1212 agencies, shall establish and administer a border operations
1313 training program for peace officers employed by local law
1414 enforcement agencies that will prepare the officers to:
1515 (1) collaborate and cooperate with and assist any law
1616 enforcement agency in the interdiction, investigation, and
1717 prosecution of criminal activity in the Texas-Mexico border region;
1818 and
1919 (2) collaborate and cooperate with and assist district
2020 attorneys, county attorneys, the border prosecution unit, and other
2121 prosecutors in the investigation and prosecution of allegations of
2222 criminal activity in the Texas-Mexico border region.
2323 (b) The training program under Subsection (a) must include:
2424 (1) information on:
2525 (A) criminal activity occurring along the
2626 Texas-Mexico border, including drug trafficking and trafficking of
2727 persons and other activity carried out by cartels, transnational
2828 gangs, and other groups engaged in organized criminal activity; and
2929 (B) methods for identifying northbound,
3030 southbound, and intrastate criminal activity associated with drug
3131 trafficking, trafficking of persons, and other organized criminal
3232 activity, including the provision of services to victims of
3333 trafficking;
3434 (2) best practices for investigating and prosecuting
3535 the criminal activity described by Subdivision (1) and securing the
3636 Texas-Mexico border; and
3737 (3) an overview of the department's operations at the
3838 Texas-Mexico border, including any collaboration with the United
3939 States Customs and Border Protection.
4040 (c) The department shall identify opportunities for a peace
4141 officer described by Subsection (a) to assist in the department's
4242 duties related to border operations. The department may authorize
4343 the officer to assist in carrying out those duties.
4444 (d) A peace officer authorized by the department to assist
4545 in carrying out duties related to the department's border
4646 operations as described by Subsection (c) is not entitled to
4747 compensation from the department for the assistance provided.
4848 (e) The department may partner with federal agencies in
4949 administering the training program under Subsection (a) and
5050 facilitating any assistance provided by a peace officer under
5151 Subsection (c).
5252 SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is
5353 amended by adding Section 1701.359 to read as follows:
5454 Sec. 1701.359. BORDER OPERATIONS TRAINING PROGRAM. The
5555 commission may:
5656 (1) recognize, or with the consent of the Department
5757 of Public Safety administer or assist in administering, the border
5858 operations training program established under Section 411.02093,
5959 Government Code, as a continuing education program for officers;
6060 and
6161 (2) credit an officer who successfully completes the
6262 program described by Subdivision (1) with the appropriate number of
6363 continuing education hours.
6464 SECTION 3. This Act takes effect September 1, 2023.
