| 6 | 6 | | relating to prohibiting the investment of the permanent university |

| 7 | 7 | | fund, the national research university fund, or money held by a |

| 8 | 8 | | public institution of higher education in financial companies that |
|---|
| 9 | 9 | | boycott certain energy companies. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 51.0031, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (e) to read as follows: |
|---|
| 13 | 13 | | (e) Chapter 809, Government Code, applies to a governing |
|---|
| 14 | 14 | | board as if the governing board were a state governmental entity |
|---|
| 15 | 15 | | under that chapter. |
|---|
| 16 | 16 | | SECTION 2. Section 62.143, Education Code, is amended by |
|---|
| 17 | 17 | | adding Subsection (c) to read as follows: |
|---|
| 18 | 18 | | (c) Chapter 809, Government Code, applies to the national |
|---|
| 19 | 19 | | research university fund as if the fund were a state governmental |
|---|
| 20 | 20 | | entity under that chapter. |
|---|
| 21 | 21 | | SECTION 3. Subchapter A, Chapter 66, Education Code, is |
|---|
| 22 | 22 | | amended by adding Section 66.015 to read as follows: |
|---|
| 23 | 23 | | Sec. 66.015. PROHIBITION ON INVESTMENT IN FINANCIAL |
|---|
| 24 | 24 | | COMPANIES THAT BOYCOTT CERTAIN ENERGY COMPANIES. Notwithstanding |
|---|
| 25 | 25 | | Section 66.01, Chapter 809, Government Code, applies to the |
|---|
| 26 | 26 | | permanent university fund as if the fund were a state governmental |
|---|
| 27 | 27 | | entity under that chapter. |
|---|
| 28 | 28 | | SECTION 4. This Act takes effect September 1, 2023. |
