55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the licensing in this state of a person licensed in
88 another jurisdiction to practice psychology, marriage and family
99 therapy, or professional counseling.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter F, Chapter 501, Occupations Code, is
1212 amended by adding Section 501.265 to read as follows:
1313 Sec. 501.265. LICENSE BY ENDORSEMENT. (a) The executive
1414 council shall issue a psychologist license or a psychological
1515 associate license, as applicable, to an applicant who holds a
1616 current, unrestricted license in another jurisdiction that
1717 maintains licensing requirements that are substantially equivalent
1818 to the requirements under this chapter. An applicant for a license
1919 under this section must:
2020 (1) present proof to the executive council that the
2121 applicant is licensed in good standing as a psychologist or
2222 psychological associate, as applicable, in that jurisdiction;
2323 (2) provide to the executive council information
2424 regarding the status of any other professional license that the
2525 applicant holds or has held in this state or another jurisdiction;
2626 (3) present proof to the executive council that the
2727 applicant has passed a jurisprudence examination required by the
2828 executive council;
2929 (4) meet the qualifications required by Section
3030 501.2525 or 501.259, as applicable;
3131 (5) not have committed an act that is grounds for
3232 disciplinary action under Section 501.401;
3333 (6) submit to the executive council a current
3434 photograph that meets the requirements for a United States
3535 passport; and
3636 (7) meet any additional requirements provided by
3737 executive council rule.
3838 (b) The executive council shall adopt rules for issuing a
3939 license with a provisional status under Section 501.253 to an
4040 applicant for a license by endorsement who encounters a delay that
4141 is outside the applicant's control in submitting to the executive
4242 council the documentation required by this section.
4343 SECTION 2. Subchapter F, Chapter 502, Occupations Code, is
4444 amended by adding Section 502.262 to read as follows:
4545 Sec. 502.262. LICENSE BY ENDORSEMENT. (a) The executive
4646 council shall issue a marriage and family therapist license or a
4747 marriage and family therapist associate license, as applicable, to
4848 an applicant who holds a current, unrestricted license in another
4949 jurisdiction that maintains licensing requirements that are
5050 substantially equivalent to the requirements under this chapter.
5151 An applicant for a license under this section must:
5252 (1) present proof to the executive council that the
5353 applicant is licensed in good standing as a marriage and family
5454 therapist or marriage and family therapist associate, as
5555 applicable, in that jurisdiction;
5656 (2) provide to the executive council information
5757 regarding the status of any other professional license that the
5858 applicant holds or has held in this state or another jurisdiction;
5959 (3) present proof to the executive council that the
6060 applicant has passed a jurisprudence examination required by the
6161 executive council;
6262 (4) meet the qualifications required by Section
6363 502.252;
6464 (5) not have committed an act that is grounds for
6565 disciplinary action under Section 502.351;
6666 (6) submit to the executive council a current
6767 photograph that meets the requirements for a United States
6868 passport; and
6969 (7) meet any additional requirements provided by
7070 executive council rule.
7171 (b) The executive council shall adopt rules for issuing a
7272 provisional license under Section 502.259 to an applicant for a
7373 license by endorsement who encounters a delay that is outside the
7474 applicant's control in submitting to the executive council the
7575 documentation required by this section.
7676 SECTION 3. Subchapter G, Chapter 503, Occupations Code, is
7777 amended by adding Section 503.315 to read as follows:
7878 Sec. 503.315. LICENSE BY ENDORSEMENT. (a) The executive
7979 council shall issue a professional counselor license to an
8080 applicant who holds a current, unrestricted license in another
8181 jurisdiction that maintains licensing requirements that are
8282 substantially equivalent to the requirements under this chapter.
8383 An applicant for a license under this section must:
8484 (1) present proof to the executive council that the
8585 applicant is licensed in good standing as a professional counselor
8686 in that jurisdiction;
8787 (2) provide to the executive council information
8888 regarding the status of any other professional license that the
8989 applicant holds or has held in this state or another jurisdiction;
9090 (3) present proof to the executive council that the
9191 applicant has passed a jurisprudence examination required by the
9292 executive council;
9393 (4) meet the qualifications required by Section
9494 503.302;
9595 (5) not have committed an act that is grounds for
9696 disciplinary action under Section 503.401;
9797 (6) submit to the executive council a current
9898 photograph that meets the requirements for a United States
9999 passport; and
100100 (7) meet any additional requirements provided by
101101 executive council rule.
102102 (b) The executive council shall adopt rules for issuing a
103103 provisional license under Section 503.310 to an applicant for a
104104 license by endorsement who encounters a delay that is outside the
105105 applicant's control in submitting to the executive council the
106106 documentation required by this section.
107107 SECTION 4. Not later than December 1, 2023, the Texas
108108 Behavioral Health Executive Council shall adopt the rules necessary
109109 to implement the changes in law made by this Act.
110110 SECTION 5. This Act takes effect September 1, 2023.
