55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the licensing in this state of a person licensed in
88 another jurisdiction to practice marriage and family therapy or
99 professional counseling.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter F, Chapter 502, Occupations Code, is
1212 amended by adding Section 502.262 to read as follows:
1313 Sec. 502.262. LICENSE BY ENDORSEMENT. (a) The executive
1414 council shall issue a marriage and family therapist license or a
1515 marriage and family therapist associate license, as applicable, to
1616 an applicant who holds a current, unrestricted license in another
1717 jurisdiction that maintains licensing requirements that are
1818 substantially equivalent to the requirements under this chapter.
1919 An applicant for a license under this section must:
2020 (1) present proof to the executive council that the
2121 applicant is licensed in good standing as a marriage and family
2222 therapist or marriage and family therapist associate, as
2323 applicable, in that jurisdiction;
2424 (2) provide to the executive council information
2525 regarding the status of any other professional license that the
2626 applicant holds or has held in this state or another jurisdiction;
2727 (3) present proof to the executive council that the
2828 applicant has passed a jurisprudence examination required by the
2929 executive council;
3030 (4) meet the qualifications required by Section
3131 502.252;
3232 (5) not have committed an act that is grounds for
3333 disciplinary action under Section 502.351;
3434 (6) submit to the executive council a current
3535 photograph that meets the requirements for a United States
3636 passport; and
3737 (7) meet any additional requirements provided by
3838 executive council rule.
3939 (b) The executive council shall adopt rules for issuing a
4040 provisional license under Section 502.259 to an applicant for a
4141 license by endorsement who encounters a delay that is outside the
4242 applicant's control in submitting to the executive council the
4343 documentation required by this section.
4444 SECTION 2. Subchapter G, Chapter 503, Occupations Code, is
4545 amended by adding Section 503.315 to read as follows:
4646 Sec. 503.315. LICENSE BY ENDORSEMENT. (a) The executive
4747 council shall issue a professional counselor license to an
4848 applicant who holds a current, unrestricted license in another
4949 jurisdiction that maintains licensing requirements that are
5050 substantially equivalent to the requirements under this chapter.
5151 An applicant for a license under this section must:
5252 (1) present proof to the executive council that the
5353 applicant is licensed in good standing as a professional counselor
5454 in that jurisdiction;
5555 (2) provide to the executive council information
5656 regarding the status of any other professional license that the
5757 applicant holds or has held in this state or another jurisdiction;
5858 (3) present proof to the executive council that the
5959 applicant has passed a jurisprudence examination required by the
6060 executive council;
6161 (4) meet the qualifications required by Section
6262 503.302;
6363 (5) not have committed an act that is grounds for
6464 disciplinary action under Section 503.401;
6565 (6) submit to the executive council a current
6666 photograph that meets the requirements for a United States
6767 passport; and
6868 (7) meet any additional requirements provided by
6969 executive council rule.
7070 (b) The executive council shall adopt rules for issuing a
7171 provisional license under Section 503.310 to an applicant for a
7272 license by endorsement who encounters a delay that is outside the
7373 applicant's control in submitting to the executive council the
7474 documentation required by this section.
7575 SECTION 3. Not later than December 1, 2023, the Texas
7676 Behavioral Health Executive Council shall adopt the rules necessary
7777 to implement the changes in law made by this Act.
7878 SECTION 4. This Act takes effect September 1, 2023.
