| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 22, Transportation Code, |
|---|
| 10 | 10 | | is amended by adding Section 22.028 to read as follows: |
|---|
| 11 | 11 | | Sec. 22.028. CONFIDENTIALITY OF CERTAIN INFORMATION |
|---|
| 12 | 12 | | COLLECTED BY LOCAL GOVERNMENT. Personal identifying information |
|---|
| 13 | 13 | | collected by a local government is confidential and not subject to |
|---|
| 14 | 14 | | disclosure under Chapter 552, Government Code, if the information |
|---|
| 15 | 15 | | collected is in relation to a person's use of an airport parking |
|---|
| 16 | 16 | | facility that includes: |
|---|
| 17 | 17 | | (1) the person's name, address, e-mail address, phone |
|---|
| 18 | 18 | | number, and zip code; |
|---|
| 19 | 19 | | (2) the person's license plate number, toll tag |
|---|
| 20 | 20 | | number, and credit, debit, or other payment card number; or |
|---|
| 21 | 21 | | (3) the dates the person's vehicle was parked at the |
|---|
| 22 | 22 | | facility, the date the person's vehicle exited the facility, and |
|---|
| 23 | 23 | | the amount the person paid to park in the facility. |

| 24 | 24 | | SECTION 2. Section 22.091, Transportation Code, is amended |
|---|
| 25 | 25 | | to read as follows: |

| 26 | 26 | | Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION |

| 27 | 27 | | COLLECTED BY JOINT BOARD. Personal identifying information |
|---|
| 28 | 28 | | collected by a joint board for which the constituent agencies are |
|---|
| 29 | 29 | | populous home-rule municipalities is confidential and not subject |
|---|
| 30 | 30 | | to disclosure under Chapter 552, Government Code, if the |
|---|
| 31 | 31 | | information collected is in relation to: |
|---|
| 32 | 32 | | (1) a commercial online payment system and includes a |
|---|
| 33 | 33 | | person's: |
|---|
| 34 | 34 | | (A) [(1)] name, address, e-mail address, or |
|---|
| 35 | 35 | | phone number; |
|---|
| 36 | 36 | | (B) [(2)] account number, password, payment |
|---|
| 37 | 37 | | transaction activity, toll or charge record, or credit, debit, or |
|---|
| 38 | 38 | | other payment card number; or |
|---|
| 39 | 39 | | (C) [(3)] other personal financial information; |
|---|
| 40 | 40 | | or |
|---|
| 41 | 41 | | (2) a person's use of an airport parking facility that |
|---|
| 42 | 42 | | includes: |
|---|
| 43 | 43 | | (A) the person's name, address, e-mail address, |
|---|
| 44 | 44 | | phone number, and zip code; |
|---|
| 45 | 45 | | (B) the person's license plate number, toll tag |
|---|
| 46 | 46 | | number, and credit, debit, or other payment card number; or |
|---|
| 47 | 47 | | (C) the dates the person's vehicle was parked at |
|---|
| 48 | 48 | | the facility, the date the person's vehicle exited the facility, |
|---|
| 49 | 49 | | and the amount the person paid to park in the facility. |

| 50 | 50 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 51 | 51 | | to a request for public information received by a governmental body |
|---|
| 52 | 52 | | or an officer for public information on or after the effective date |
|---|
| 53 | 53 | | of this Act. |
|---|
| 54 | 54 | | SECTION 4. This Act takes effect September 1, 2023. |
