| 7 | 7 | | relating to the evaluation of child-care providers participating in |

| 8 | 8 | | the Texas Rising Star Program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2308.3155, Government Code, is amended |
|---|
| 11 | 11 | | by adding Subsections (b-3) and (b-4) to read as follows: |
|---|
| 12 | 12 | | (b-3) When determining the provider's rating under the |
|---|
| 13 | 13 | | rating system adopted under Subsection (b), the commission shall |
|---|
| 14 | 14 | | consider: |
|---|
| 15 | 15 | | (1) comments from caregivers employed by the |
|---|
| 16 | 16 | | child-care provider and parents of children receiving care from the |
|---|
| 17 | 17 | | provider; |
|---|
| 18 | 18 | | (2) information regarding any investigations by the |
|---|
| 19 | 19 | | Department of Family and Protective Services relating to the |
|---|
| 20 | 20 | | provider; and |
|---|
| 21 | 21 | | (3) a provider's detailed licensing information, |
|---|
| 22 | 22 | | including any reports against the provider for a violation of the |
|---|
| 23 | 23 | | minimum standards for the provider and any adverse action taken by |
|---|
| 24 | 24 | | the Health and Human Services Commission against the provider's |
|---|
| 25 | 25 | | license or registration. |

| 26 | 26 | | (b-4) The commission shall collaborate with the Department |
|---|
| 27 | 27 | | of Family and Protective Services and the Health and Human Services |
|---|
| 28 | 28 | | Commission to obtain the information described by Subsections |
|---|
| 29 | 29 | | (b-3)(2) and (3). |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
