| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter E, Chapter 801, Occupations Code, is |
|---|
| 9 | 9 | | amended by adding Section 801.2052 to read as follows: |
|---|
| 10 | 10 | | Sec. 801.2052. DISMISSAL OF BASELESS OR UNFOUNDED |
|---|
| 11 | 11 | | COMPLAINT. (a) If, before the 180th day after the date the board's |
|---|
| 12 | 12 | | official investigation of a complaint is commenced, the board |
|---|
| 13 | 13 | | determines in accordance with rules adopted under this section that |
|---|
| 14 | 14 | | a complaint filed with the board is baseless or unfounded, the board |
|---|
| 15 | 15 | | shall: |
|---|
| 16 | 16 | | (1) dismiss the complaint; and |
|---|
| 17 | 17 | | (2) include a statement in the record of the complaint |
|---|
| 18 | 18 | | that the complaint was dismissed because the complaint was baseless |
|---|
| 19 | 19 | | or unfounded. |
|---|
| 20 | 20 | | (b) The board shall adopt rules to implement this section |
|---|
| 21 | 21 | | and establish criteria for determining that a complaint is baseless |
|---|
| 22 | 22 | | or unfounded. |
|---|
| 23 | 23 | | SECTION 2. Rules adopted under Section 801.2052, |
|---|
| 24 | 24 | | Occupations Code, as added by this Act, may not take effect until |
|---|
| 25 | 25 | | September 1, 2025. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2023. |
