55 relating to the dismissal of a baseless or unfounded complaint
66 filed with the State Board of Veterinary Medical Examiners.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter E, Chapter 801, Occupations Code, is
99 amended by adding Section 801.2052 to read as follows:
1010 Sec. 801.2052. DISMISSAL OF BASELESS OR UNFOUNDED
1111 COMPLAINT. (a) If, before the 180th day after the date the board's
1212 official investigation of a complaint is commenced, the board
1313 determines in accordance with rules adopted under this section that
1414 a complaint filed with the board is baseless or unfounded, the board
1515 shall:
1616 (1) dismiss the complaint; and
1717 (2) include a statement in the record of the complaint
1818 that the complaint was dismissed because the complaint was baseless
1919 or unfounded.
2020 (b) The board shall adopt rules to implement this section
2121 and establish criteria for determining that a complaint is baseless
2222 or unfounded.
2323 SECTION 2. Rules adopted under Section 801.2052,
2424 Occupations Code, as added by this Act, may not take effect until
2525 September 1, 2025.
2626 SECTION 3. This Act takes effect September 1, 2023.
