| 8 | 8 | | operator's and certain exclusionary automobile insurance policies. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter D, Chapter 601, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 601.0815 to read as follows: |
|---|
| 12 | 12 | | Sec. 601.0815. PROOF OF MOTOR VEHICLE LIABILITY INSURANCE |
|---|
| 13 | 13 | | FORM FOR OPERATOR'S POLICIES AND CERTAIN EXCLUSIONARY POLICIES. |
|---|
| 14 | 14 | | (a) This section applies only to a motor vehicle liability |
|---|
| 15 | 15 | | insurance policy that: |
|---|
| 16 | 16 | | (1) is an operator's policy; or |
|---|
| 17 | 17 | | (2) excludes from coverage an individual who has |
|---|
| 18 | 18 | | permission to use a covered vehicle from the named insured. |
|---|
| 19 | 19 | | (b) The Texas Department of Insurance shall prescribe a |
|---|
| 20 | 20 | | proof of insurance form for an operator's policy that includes the |
|---|
| 21 | 21 | | information described by Section 601.081 and a statement in |
|---|
| 22 | 22 | | 24-point font that: |
|---|
| 23 | 23 | | (1) states the policy is an operator's policy; and |
|---|
| 24 | 24 | | (2) describes any vehicle excluded from coverage. |
|---|
| 25 | 25 | | (c) The Texas Department of Insurance shall prescribe a |
|---|
| 26 | 26 | | proof of insurance form for a policy described by Subsection (a)(2) |
|---|
| 27 | 27 | | that includes the information described by Section 601.081 and a |
|---|
| 28 | 28 | | statement in 24-point font that: |
|---|
| 29 | 29 | | (1) states the policy excludes certain individuals |
|---|
| 30 | 30 | | with permission to use the covered vehicle; |
|---|
| 31 | 31 | | (2) names the policyholder; and |
|---|
| 32 | 32 | | (3) describes the individuals excluded from coverage, |
|---|
| 33 | 33 | | including by name if applicable, and states whether the policy |
|---|
| 34 | 34 | | excludes individuals not in the same household as the named |
|---|
| 35 | 35 | | insured. |
|---|
| 36 | 36 | | (d) The commissioner of insurance may adopt rules necessary |
|---|
| 37 | 37 | | to implement this section. |
|---|
| 38 | 38 | | SECTION 2. Section 601.454, Transportation Code, is amended |
|---|
| 39 | 39 | | by adding Subsection (a-1) to read as follows: |
|---|
| 40 | 40 | | (a-1) This subsection applies only to a motor vehicle |
|---|
| 41 | 41 | | liability insurance policy that is an operator's policy or excludes |
|---|
| 42 | 42 | | from coverage an individual who has permission to use a covered |
|---|
| 43 | 43 | | vehicle from the named insured. In addition to the information |
|---|
| 44 | 44 | | provided under Subsection (a), an insurance company shall provide |
|---|
| 45 | 45 | | to the agent the information described by Section 601.0815(b) or |
|---|
| 46 | 46 | | (c), as applicable, for each policy to which this subsection |
|---|
| 47 | 47 | | applies that is issued by the insurance company. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect September 1, 2023. |
