| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 753, Health and Safety Code, is amended |
|---|
| 11 | 11 | | by adding Section 753.0041 to read as follows: |
|---|
| 12 | 12 | | Sec. 753.0041. ABOVEGROUND STORAGE TANKS; BLAST RADIUS |
|---|
| 13 | 13 | | REPORT. (a) This section applies only to an aboveground storage |
|---|
| 14 | 14 | | tank that has a capacity of 5,000 gallons or more and stores a |
|---|
| 15 | 15 | | flammable liquid. |
|---|
| 16 | 16 | | (b) The operator of an aboveground storage tank shall submit |
|---|
| 17 | 17 | | a blast radius report to: |
|---|
| 18 | 18 | | (1) the county fire marshal for the county in which the |
|---|
| 19 | 19 | | aboveground storage tank is located; and |
|---|
| 20 | 20 | | (2) if applicable, the municipal fire marshal for the |
|---|
| 21 | 21 | | municipality in which the aboveground storage tank is located. |
|---|
| 22 | 22 | | (c) The board shall prescribe the form and content of the |
|---|
| 23 | 23 | | blast radius report. A blast radius report submitted under this |
|---|
| 24 | 24 | | section must contain a description of the maximum potential blast |
|---|
| 25 | 25 | | radius that would result from an explosion of the aboveground |
|---|
| 26 | 26 | | storage tank. |
|---|
| 27 | 27 | | (d) A fire marshal who receives a blast radius report under |
|---|
| 28 | 28 | | this section shall make the report publicly available. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
