55 relating to requiring the establishment of policy frameworks for
66 research security at public institutions of higher education.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
99 amended by adding Section 51.956 to read as follows:
1010 Sec. 51.956. POLICY FRAMEWORK FOR RESEARCH SECURITY. (a)
1111 In this section, "governing board," "institution of higher
1212 education," and "university system" have the meanings assigned by
1313 Section 61.003.
1414 (b) The governing board of each institution of higher
1515 education shall establish a policy framework that promotes secure
1616 academic research at the institution while mitigating the risk of
1717 foreign espionage and interference. The governing board of a
1818 university system must establish a separate policy framework for
1919 each institution of higher education under the governing board's
2020 management and control.
2121 (c) The policy framework must address:
2222 (1) achieving the highest level of compliance with
2323 applicable ethical, legal, regulatory, contractual, and system
2424 standards and requirements for securing and protecting the
2525 institution's research portfolios;
2626 (2) promoting within the institution an
2727 organizational culture of compliance with federal requirements to
2828 ensure the institution maintains eligibility for federal funding;
2929 and
3030 (3) designating a person to serve as a research
3131 security officer responsible for maintaining classified
3232 information, maintaining controlled unclassified information,
3333 conducting foreign influence reporting, and addressing other
3434 issues at the institution associated with the goals of the policy
3535 framework.
3636 (d) For purposes of designating a person to serve as a
3737 research security officer under Subsection (c)(3), the governing
3838 board of a university system may designate a person to serve in an
3939 institutional or system-wide capacity.
4040 (e) A person designated to serve as a research security
4141 officer under Subsection (c)(3) shall attend the annual academic
4242 security and counter exploitation program seminar offered by Texas
4343 A&M University.
4444 SECTION 2. As soon as practicable after the effective date
4545 of this Act, the governing board of each public institution of
4646 higher education shall establish the policy framework for research
4747 security required under Section 51.956, Education Code, as added by
4848 this Act.
4949 SECTION 3. This Act takes effect September 1, 2023.
