| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 31, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 31.107 to read as follows: |
|---|
| 11 | 11 | | Sec. 31.107. REQUIRED PHYSICAL COPIES OF INSTRUCTIONAL |
|---|
| 12 | 12 | | MATERIALS. (a) This section applies only to instructional |
|---|
| 13 | 13 | | materials provided in a physical medium. |
|---|
| 14 | 14 | | (b) The board of trustees of each school district and the |
|---|
| 15 | 15 | | governing body of each open-enrollment charter school shall, for |
|---|
| 16 | 16 | | each instructional material selected by the district or school for |
|---|
| 17 | 17 | | a subject in the foundation or enrichment curriculum: |
|---|
| 18 | 18 | | (1) make available at least one physical copy of the |
|---|
| 19 | 19 | | instructional material in each classroom in which the instructional |
|---|
| 20 | 20 | | material is used; |
|---|
| 21 | 21 | | (2) provide to each teacher at a district or school who |
|---|
| 22 | 22 | | uses the instructional material in teaching a course a physical |
|---|
| 23 | 23 | | copy of the teacher version of the instructional material, if |
|---|
| 24 | 24 | | available; and |
|---|
| 25 | 25 | | (3) maintain in the school library at each district or |
|---|
| 26 | 26 | | school campus at which the instructional material is used a number |
|---|
| 27 | 27 | | of physical copies of the instructional material at least equal to |
|---|
| 28 | 28 | | five percent of the total number of students in the grade level in |
|---|
| 29 | 29 | | which the instructional material is used. |
|---|
| 30 | 30 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 31 | 31 | | school year. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2023. |
