55 AN ACT
66 relating to requiring public schools to maintain physical copies of
77 certain instructional materials.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 31, Education Code, is
1010 amended by adding Section 31.107 to read as follows:
1111 Sec. 31.107. REQUIRED PHYSICAL COPIES OF INSTRUCTIONAL
1212 MATERIALS. (a) This section applies only to instructional
1313 materials provided in a physical medium.
1414 (b) The board of trustees of each school district and the
1515 governing body of each open-enrollment charter school shall, for
1616 each instructional material selected by the district or school for
1717 a subject in the foundation or enrichment curriculum:
1818 (1) make available at least one physical copy of the
1919 instructional material in each classroom in which the instructional
2020 material is used;
2121 (2) provide to each teacher at a district or school who
2222 uses the instructional material in teaching a course a physical
2323 copy of the teacher version of the instructional material, if
2424 available; and
2525 (3) maintain in the school library at each district or
2626 school campus at which the instructional material is used a number
2727 of physical copies of the instructional material at least equal to
2828 five percent of the total number of students in the grade level in
2929 which the instructional material is used.
3030 SECTION 2. This Act applies beginning with the 2023-2024
3131 school year.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2023.
