| 7 | 7 | | relating to the review of the creation of certain proposed |

| 8 | 8 | | municipal utility districts by county commissioners courts. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 54.0161(a-2) and (b), Water Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a-2) The commissioners court of a county in which the |
|---|
| 13 | 13 | | district is to be located shall [may] review the petition for |
|---|
| 14 | 14 | | creation and other evidence and information relating to the |
|---|
| 15 | 15 | | proposed district that the commissioners consider necessary. |
|---|
| 16 | 16 | | Petitioners for the creation of a district shall submit to the |
|---|
| 17 | 17 | | county commissioners court any relevant information requested by |
|---|
| 18 | 18 | | the commissioners court. |
|---|
| 19 | 19 | | (b) The [In the event the county commissioners court votes |
|---|
| 20 | 20 | | to submit information to the commission or to make a recommendation |
|---|
| 21 | 21 | | regarding the creation of the proposed district, the] commissioners |
|---|
| 22 | 22 | | court shall submit to the commission, at least 10 days before the |
|---|
| 23 | 23 | | date set for action on the petition, a written opinion stating: |
|---|
| 24 | 24 | | (1) whether the commissioners court recommends the |
|---|
| 25 | 25 | | creation of the proposed district; and |
|---|
| 26 | 26 | | (2) any findings, conclusions, and other information |
|---|
| 27 | 27 | | that the commissioners court thinks would assist the commission in |
|---|
| 28 | 28 | | making a final determination on the petition. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
