66 AN ACT
77 relating to the limitations period for certain criminal offenses
88 based on assaultive conduct.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 12.01, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1313 felony indictments may be presented within these limits, and not
1414 afterward:
1515 (1) no limitation:
1616 (A) murder and manslaughter;
1717 (B) sexual assault under Section 22.011(a)(2),
1818 Penal Code, or aggravated sexual assault under Section
1919 22.021(a)(1)(B), Penal Code;
2020 (C) sexual assault, if:
2121 (i) during the investigation of the offense
2222 biological matter is collected and the matter:
2323 (a) has not yet been subjected to
2424 forensic DNA testing; or
2525 (b) has been subjected to forensic DNA
2626 testing and the testing results show that the matter does not match
2727 the victim or any other person whose identity is readily
2828 ascertained; or
2929 (ii) probable cause exists to believe that
3030 the defendant has committed the same or a similar sex offense
3131 against five or more victims;
3232 (D) continuous sexual abuse of young child or
3333 disabled individual under Section 21.02, Penal Code;
3434 (E) indecency with a child under Section 21.11,
3535 Penal Code;
3636 (F) an offense involving leaving the scene of an
3737 accident under Section 550.021, Transportation Code, if the
3838 accident resulted in the death of a person;
3939 (G) trafficking of persons under Section
4040 20A.02(a)(7) or (8), Penal Code;
4141 (H) continuous trafficking of persons under
4242 Section 20A.03, Penal Code; or
4343 (I) compelling prostitution under Section
4444 43.05(a)(2), Penal Code;
4545 (2) ten years from the date of the commission of the
4646 offense:
4747 (A) theft of any estate, real, personal or mixed,
4848 by an executor, administrator, guardian or trustee, with intent to
4949 defraud any creditor, heir, legatee, ward, distributee,
5050 beneficiary or settlor of a trust interested in such estate;
5151 (B) theft by a public servant of government
5252 property over which the public servant exercises control in the
5353 public servant's official capacity;
5454 (C) forgery or the uttering, using or passing of
5555 forged instruments;
5656 (D) injury to an elderly or disabled individual
5757 punishable as a felony of the first degree under Section 22.04,
5858 Penal Code;
5959 (E) sexual assault, except as provided by
6060 Subdivision (1) or (7);
6161 (F) arson;
6262 (G) trafficking of persons under Section
6363 20A.02(a)(1), (2), (3), or (4), Penal Code; or
6464 (H) compelling prostitution under Section
6565 43.05(a)(1), Penal Code;
6666 (3) seven years from the date of the commission of the
6767 offense:
6868 (A) misapplication of fiduciary property or
6969 property of a financial institution;
7070 (B) fraudulent securing of document execution;
7171 (C) a felony violation under Chapter 162, Tax
7272 Code;
7373 (D) false statement to obtain property or credit
7474 under Section 32.32, Penal Code;
7575 (E) money laundering;
7676 (F) credit card or debit card abuse under Section
7777 32.31, Penal Code;
7878 (G) fraudulent use or possession of identifying
7979 information under Section 32.51, Penal Code;
8080 (H) exploitation of a child, elderly individual,
8181 or disabled individual under Section 32.53, Penal Code;
8282 (I) health care fraud under Section 35A.02, Penal
8383 Code; or
8484 (J) bigamy under Section 25.01, Penal Code,
8585 except as provided by Subdivision (6);
8686 (4) five years from the date of the commission of the
8787 offense:
8888 (A) theft or robbery;
8989 (B) except as provided by Subdivision (5),
9090 kidnapping or burglary;
9191 (C) injury to an elderly or disabled individual
9292 that is not punishable as a felony of the first degree under Section
9393 22.04, Penal Code;
9494 (D) abandoning or endangering a child; [or]
9595 (E) insurance fraud;
9696 (F) assault under Section 22.01, Penal Code, if
9797 the assault was committed against a person whose relationship to or
9898 association with the defendant is described by Section 71.0021(b),
9999 71.003, or 71.005, Family Code;
100100 (G) continuous violence against the family under
101101 Section 25.11, Penal Code; or
102102 (H) aggravated assault under Section 22.02,
103103 Penal Code;
104104 (5) if the investigation of the offense shows that the
105105 victim is younger than 17 years of age at the time the offense is
106106 committed, 20 years from the 18th birthday of the victim of one of
107107 the following offenses:
108108 (A) sexual performance by a child under Section
109109 43.25, Penal Code;
110110 (B) aggravated kidnapping under Section
111111 20.04(a)(4), Penal Code, if the defendant committed the offense
112112 with the intent to violate or abuse the victim sexually; or
113113 (C) burglary under Section 30.02, Penal Code, if
114114 the offense is punishable under Subsection (d) of that section and
115115 the defendant committed the offense with the intent to commit an
116116 offense described by Subdivision (1)(B) or (D) of this article or
117117 Paragraph (B) of this subdivision;
118118 (6) ten years from the 18th birthday of the victim of
119119 the offense:
120120 (A) trafficking of persons under Section
121121 20A.02(a)(5) or (6), Penal Code;
122122 (B) injury to a child under Section 22.04, Penal
123123 Code; or
124124 (C) bigamy under Section 25.01, Penal Code, if
125125 the investigation of the offense shows that the person, other than
126126 the legal spouse of the defendant, whom the defendant marries or
127127 purports to marry or with whom the defendant lives under the
128128 appearance of being married is younger than 18 years of age at the
129129 time the offense is committed;
130130 (7) two years from the date the offense was
131131 discovered: sexual assault punishable as a state jail felony under
132132 Section 22.011(f)(2), Penal Code; or
133133 (8) three years from the date of the commission of the
134134 offense: all other felonies.
135135 SECTION 2. Article 12.02, Code of Criminal Procedure, is
136136 amended to read as follows:
137137 Art. 12.02. MISDEMEANORS. (a) Except as provided by
138138 Subsection (b), the following charging instruments may be presented
139139 within two years from the date of the commission of the offense, and
140140 not afterward:
141141 (1) an [An] indictment or information for any Class A
142142 or Class B misdemeanor; and
143143 (2) a [may be presented within two years from the date
144144 of the commission of the offense, and not afterward.
145145 [(b) A] complaint or information for any Class C
146146 misdemeanor.
147147 (b) An indictment, information, or complaint, as
148148 applicable, for assault under Section 22.01, Penal Code, may be
149149 presented within three [two] years from the date of the commission
150150 of the offense, and not afterward, if the offense:
151151 (1) is punishable as a misdemeanor; and
152152 (2) was committed against a person whose relationship
153153 to or association with the defendant is described by Section
154154 71.0021(b), 71.003, or 71.005, Family Code.
155155 SECTION 3. The change in law made by this Act does not apply
156156 to an offense if the prosecution of that offense becomes barred by
157157 limitation before the effective date of this Act. The prosecution
158158 of that offense remains barred as if this Act had not taken effect.
159159 SECTION 4. This Act takes effect September 1, 2023.
