55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to complaints filed by a school district regarding the
88 offense of contributing to truancy by a parent.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.0951(b), Education Code, is amended
1111 to read as follows:
1212 (b) If a student fails to attend school without excuse as
1313 specified by Subsection (a), a school district shall [may] file a
1414 complaint against the student's parent in a county, justice, or
1515 municipal court for an offense under Section 25.093 if the school
1616 district possesses and is able to provide to the court [provides]
1717 evidence of the parent's criminal negligence. In this subsection,
1818 "parent" includes a person standing in parental relation.
1919 SECTION 2. This Act applies beginning with the 2023-2024
2020 school year.
2121 SECTION 3. This Act takes effect September 1, 2023.
