| 7 | 7 | | relating to complaints filed by a school district regarding the |

| 8 | 8 | | offense of contributing to truancy by a parent. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.0951(b), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) If a student fails to attend school without excuse as |
|---|
| 13 | 13 | | specified by Subsection (a), a school district shall [may] file a |
|---|
| 14 | 14 | | complaint against the student's parent in a county, justice, or |
|---|
| 15 | 15 | | municipal court for an offense under Section 25.093 if the school |
|---|
| 16 | 16 | | district possesses and is able to provide to the court [provides] |
|---|
| 17 | 17 | | evidence of the parent's criminal negligence. In this subsection, |
|---|
| 18 | 18 | | "parent" includes a person standing in parental relation. |
|---|
| 19 | 19 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 20 | 20 | | school year. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2023. |
